<br />ORDINANCE NO. 06.1175 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING <br />THE CODE OF ORDINANCES OF THE CITY OF CASSELBERRY, BY <br />SUBSTANTIALLY AMENDING, REVISING AND UPDATING CHAPTER 26, <br />"OCCUPATIONAL LICENSE TAX"; AMENDING SECTION 26.26 <br />"DEFINITIONS" TO EXPAND THE TERM "BUSINESS"; AMENDING <br />SECTION 26.33, "LICENSE REQUIRED", TO CLARIFY LANGUAGE; <br />AMENDING SECTION 26.36, "PREREQUISITES FOR ISSUANCE OF <br />LICENSE", ADDING DESIGNEE; DELETION OF 26.38(C), "DISPLAY OF <br />LICENSE IDENTIFICATION STICKERS"; AMENDING SECTION 26.39, <br />"TRANSFER OF LICENSE", INCREASING THE TRANSFER FEE; SECTION <br />26.40 "REPLACEMENT OF LICENSE FEE", INCREASING THE <br />REPLACEMENT FEE; SECTION 26.43 "EXEMPTIONS", ADDING <br />LANGUAGE TO INCLUDE NONPROFIT ORGANIZATION REQUIREMENTS; <br />SECTION 26.44 "DELINQUENCY; PENALTY FOR FAILURE TO OBTAIN <br />LICENSE", AMENDING AND ADDING LANGUAGE FOR DELINQUENT <br />OCCUPATIONAL LICENSES; SECTION 26.45 "FEE SCHEDULE", <br />ADOPTING AN UPDATED FEE SCHEDULE; PROVIDING FOR <br />SEVERABILITY, CODIFICATION, CONFLICTS AND AN EFFECTIVE DATE. <br /> <br />WHEREAS, Occupational License Tax Code was codified by Ordinance No. 448 in the City Code effective <br /> <br />January 12, 1982 by the City Commission; and <br /> <br />WHEREAS, a Tax Equity Study was adopted by Ordinance No. 95-837 on September 11, 1995 by the City <br /> <br />Commission; and <br /> <br />WHEREAS, ~205.0535(4), Florida Statutes, allows the City to increase its occupational license fees by up <br /> <br />to 5% every other year upon a City Commission vote of a majority plus one; and <br /> <br />WHEREAS, the fee schedule has not been revised since adoption of Ordinance No. 95.837 in 1995; and <br /> <br />WHEREAS, the City Commission desires to charge an appropriate tax for businesses conducted within the <br /> <br />City; and <br /> <br />WHEREAS, additional language is needed to clarify phrases within Sections of Part " of the Code of <br /> <br />Ordinances; and <br /> <br />WHEREAS, words with double underlined type shall constitute additions to the original text and slfike <br />l~reu~~ shall constitute deletions to the onginaltext. <br />
