City Commission Meeting July 24, 2006 Page 9 Staff Recommendation: Approve as subm itted. MOTION: Moved by Commissioner Linda Hart to approve the Special InvoicelMinor Contract Report as submitted. Motion was seconded by Commissioner Susan Doerner and carried on a 5 - 0 vote. B. Tentative Tax Rate for Fiscal Year 2006 -2007 Staff Presentation: Pursuant to the Truth in Millage Legislation 'TRIM", the City Commission is required to set the proposed millage rate for Fiscal Year 2006-2007 within thirty-five (35) days of certification of taxable value by the Property Appraiser. This proposed millage rate must be transmitted to the Property Appraiser by August 4, 2006. The proposed millage rate cannot be increased at the Public Hearings, but the millage can be decreased. Staff Recommendation: Approval of the proposed millage rate at 5.00 mills as presented in the 2006-2007 budget and set the tentative Public Hearing for September II, 2006 and the final Public Hearing for September 25, 2006. MOTION: Moved by Commissioner Colleen S. Hufford to approve the Tentative Millage Rate for F.Y. 2007 at 5.00 mills as presented by the City Manager. Motion was seconded by Commissioner Susan Doerner and carried on a 5 - 0 vote. C. Resolution 06-1693 - Third Amendment to the Conceptual Plan Agreement between the City of Casselberry and Unicorp National Developments, Inc. The City Clerk read Resolution 06-1693 by title as follows: "A RESOLUTION OF THE CITY OF CASSELBERRY,FLORIDA, AUTHORIZING THE MAYOR TO EXECUTE THE THIRD AMENDMENT TO CONCEPTUAL PLAN AGREEMENT BETWEEN THE CITY AND UNICORP NATIONAL DEVELOPMENTS, INC.; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." Staff Presentation: UnicorpNational Developments, Inc., has presented a request for a third amendment to the Third Amendment to Conceptual Plan Agreement between Unicorp and the City. The Amendment will change the date for entering into a "Water Retention Area Construction and Joint Uti lization Agreement and Cross Grant of Easements" from July 14,2006 to August 4,2006. All other items in the contract will remain the same. Staff Recommendation: Approval of Resolution 06-1693. Audience Input: John Casselberry, 700 S. Lost Lake Lane, Casselberry, Florida, questioned the soil testings for the property.
