<br />City Commission Meeting <br />May 22, 2006 <br />Page 9 <br /> <br />stand-alone Starbucks and a multi-tenant building totaling 12, 850 sq. ft., to include a BB&T Bank, <br />Smoothie's, Quizno's, etc. The preliminary plat complies with the Casselberry Unified Land Development <br />Regulations and because this is a major subdivision, it requires City Commission approval. The preliminary <br />plat is in conformance with Code Section 4-19.6.B.3.c and there are no dedications to the City of Casselberry <br />or to Seminole County. At their meeting of May 10, 2006, the Planning and Zoning Commission <br />recommended approval of the plat. <br /> <br />Staff Recommendation: Approval of Preliminary Plat and Hold Harmless and Indemnification Agreement <br />for SP 06-03. The City Attorney has also reviewed and recommended approval. <br /> <br />MOTION: <br /> <br />Moved by Commissioner Colleen S. Hufford to approve SP 06-03, Howell <br />Branch Corners Preliminary Plat, as presented. Motion was seconded by <br />Commissioner Susan Doerner and carried on a 5 - 0 vote. <br /> <br />K. City Attorney Resignation from Stenstrom, Mcintosh, Colbert, Whigham, Reischmann & Partlow, <br />P.A. <br /> <br />The City Attorney, Katie Reischmann, has provided notice that she will be leaving the law firm of Stenstrom, <br />McIntosh to join the law firm of Brown, Garganese, Weiss and D'Argresta, effective June 5, 2006. Options <br />for the Commission to consider are: <br /> <br />. Continue the services of Ms. Reischmann and transfer all City of Casselberry files to Brown, <br />Garganese, Weiss and D'Argresta at the rate of$150 per hour until October 1, 2008; <br /> <br />Remain with Stenstrom McIntosh; the firm has indicated that the services of Mr. Ken <br />McIntosh would be assigned to represent the City; <br /> <br />Choose another law firm to represent the City. <br /> <br />MOTION: <br /> <br />Moved by Commissioner Colleen S. Hufford to continue with the services of <br />Katie Reischmann and transfer legal representation to the law firm of Brown, <br />Garganese, Weiss and D' Argresta. Motion was seconded Commissioner Susan <br />Doerner and carried on a 5 - O. <br /> <br />L.
