<br />City Commission Meeting <br />March 27, 2006 <br />Page 5 <br /> <br />City Attorney with the assistance of staff. The policy provides the essential flexibility for the City to <br />negotiate the purchase of necessary properties and provides the necessary safeguards to protect the City and <br />is consistent with Florida State Statutes. <br /> <br />Staff Recommendation: Approve Resolution 06-1663. <br /> <br />Audience InDut: John Casselberry, 700 S. Lost Lake Lane, stated Policy language should be more broad. <br /> <br />MOTION: <br /> <br />Moved by Commissioner Colleen S. Hufford to approve Resolution 06-1663, <br />Real Property and Permanent Easement Purchasing Policy, as presented. <br />Motion was seconded by Commissioner Linda Hart for discussion. <br /> <br />Mayor Goff stated that he was opposed to Section II (1) which requires only one appraisal for purchases <br />under $150,000. He requested an amendment to the motion that would require Section ll( I) be changed to <br />stipulate two appraisals for purchases under $150,000. The City Attorney stated that the number of required <br />appraisals and the $150,000 figure were chosen because it is the guideline used in the Florida Statutes that <br />refers to the purchases of real properties by municipalities. <br /> <br />AMENDED <br />MOTION: <br /> <br />Mayor Goff moved to approve Resolution 06-1663 with the modification to <br />Section 11(1) of the Proposed Policy to require two appraisals for property <br />purchases under $150,000. Motion was seconded by Commissioner Kathy <br />Cook. <br /> <br />Commissioner Doerner stated that she was opposed to requiring two appraisals because of the cost. <br /> <br />Commissioner Hufford stated that based on the City Attorney's statement, that she would be opposed to <br />requiring two appraisals because of the cost and her original motion, which stipulated approval of one <br />appraisal, still stands. <br /> <br />VOTE ON ORIGINAL MOTION: <br /> <br />Motion to approve Resolution 06-1163 as presented failed on a 3 - 2 vote. <br />Mayor Goff, Commissioner Cook and Commissioner Hart dissenting. <br /> <br />VOTE ON AMENDED MOTION: <br /> <br />Motion to approve Resolution 06-1663 with modification regarding appraisals <br />carried on a 3 - 2 vote. Commissioner Doerner and Commissioner Hufford <br />dissenting. <br />
