<br />Commission, in its sole and exclusive legislative discretion, decide to enact such <br />legislation after the referendum election, it is also the intent of the Commission to <br />then prepare an ordinance which will set forth the particular details of the <br />legislation. Prior to the adoption of the ordinance containing such legislation, the <br />Commission will hold the requisite number of public hearings as required by law <br />to consider the final approval or disapproval of the ordinance. <br /> <br />b) Ballot Question. Concurrent with the general election scheduled for November <br />3, 1998, the following question shall be placed on the ballot following the <br />placement on the ballot of candidates for the office of City Commissioner, if any. <br />The caption and question shall be substantially worded as follows: <br /> <br />NON-BINDING OUESTION <br />LEGISLATION PROHIBITING PERSON FROM PUBLICLY APPEARING <br />NUDE IN LICENSED ALCOHOLIC BEVERAGE ESTABLISHMENTS <br /> <br />This question is for informational purposes only and is non-binding: <br /> <br />Shall the City of Casselberry enact legislation that prohibits a <br />person from publicly appearing nude in any establishment that is <br />licensed by the State of Florida to permit the sale, service or <br />consumption of alcoholic beverages? <br /> <br />_ YES -- Approve of enacting legislation. <br /> <br />_ NO -- Disapprove of enacting legislation. <br /> <br />Section 3. City Clerk Responsibilities; Coordination with Supervisor of Elections. The <br />City Clerk is hereby authorized and directed to instruct, and coordinate with, the Supervisor of <br />Elections of Seminole County to include the caption and question set forth in Section 2(b) of this <br />ordinance on the ballot concurrent with the general election to be held on November 3, 1998. The <br />City Clerk is hereby directed to have printed the ballots necessary for the aforementioned <br />referendum, which ballots shall include the caption and ballot question set forth in Section 2(b) <br />of this ordinance. The City Clerk is hereby directed to conduct said City election to provide for <br />absentee voting and to provide for the canvassing of the returns, consistent with applicable law. <br /> <br />Section 4. <br /> <br />Notice of Non-Binding Referendum Election. <br /> <br />a) <br /> <br />General notice shall be first published at least thirty (30) days prior to the <br />November 3, 1998 election. The publication of said notice shall be made at least <br /> <br />3 <br />
