<br />WHEREAS, the City Commission finds that the most effective way to obtain public input <br />is to hold a non-binding referendum which poses a ballot question on whether the citizens of <br />Casselberry approve or disapprove of legislation that would prohibit a person from publicly <br />appearing nude in any establishment that is licensed by the State of Florida to permit the sale, <br />service, or consumption of alcoholic beverages; and <br /> <br />WHEREAS, the ballot question will be presented to the citizens of Casselberry for a vote <br />concurrent with the November 3, 1998 general election; and <br /> <br />WHEREAS, the City Commission hereby declares that this ordinance is in the best <br />interests of the public health, safety, welfare, morals, and order of the citizens of Casselberry. <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Referendum Election. A referendum election is hereby called and scheduled to <br />be held concurrent with the general election on the 3'd day of November, 1998, to determine <br />whether the ballot question appearing in Section 2(b) hereof shall be approved or disapproved by <br />a majority of the votes cast in such election in which qualified electors of the City of Casselberry <br />shall participate. Such referendum election shall be held and conducted in the manner prescribed <br />by law. The places for voting in such referendum election shall be at such locations established <br />by the Seminole County Supervisor of Elections for the general election to be held on November <br />3, 1998. All duly qualified electors of the City of Casselberry shall be entitled to participate in <br />said election. <br /> <br />Section 2. <br /> <br />Non-Binding Referendmn Question. <br /> <br />a) <br /> <br />Intent. Pursuant to Section 101.161, Florida Statutes, it is the intent of the <br />City Commission to authorize a non-binding referendum election on the ballot <br />question set forth in Section 2(b) of this ordinance. It is further the intent of the <br />Commission to use the election results of the ballot question as an informational <br />poll of the citizens of Casselberry on their approval or disapproval of the City of <br />Casselberry enacting legislation that would prohibit a person from publicly <br />appearing nude in any establishment that is licensed by the State of Florida to <br />permit the sale, service or consumption of alcoholic beverages.
