Public Hearing and Second Reading of Ordinance 05-1169, Wests ide Area Future Land Use Map Amendment (LPA 05-07) The City Clerk read Ordinance 05-1169 by title as follows: "AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL FUTURE LAND USE MAP ,ESTABLISHING THE FUTURE LAND USE MAP DESIGNATIONS FOR THOSE SPECIFIC PARCELS AS DESCRIBED IN SECTION 1 OF THIS ORDINANCE IN ACCORDANCE WITH THE "WESTSIDE SMALL AREA STUDY CONCEPTUAL PLAN;" PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." Le!!al Advertisement: The notice for the second public hearing for Ordinance 05-1169 was advertised in the Orlando Sentinel on Sunday, October 30, 2005. Staff Presentations: Ordinance 05- I 169 amends the Future Land Use Map Amendment designation of properties identified by the Westside Small Area Study Conceptual Plan that was approved by the City Commission on January 10,2005. The revisions in Ordinance 05-1 169 affect the designation of77 separate parcels totaling 34.72 acres. The proposed designations correspond to existing or proposed zoning classifications in the Ordinance 05-1170. This amendment was processed as a large scale map amendment and transmitted to the State Department of Community Affairs. The City Public Works Department and Seminole County School Board responded to the concerns by letter which stated that water/sewer capacity and school facilities were adequate. These letters both dated November 2, 2005 will be forward to the Department of Community Affairs who will issue a "Notice oflntent" oftheirapproval. Ordinance 05-1169 will take effect thirty-one days after adoption by the City Commission. Staff Recommendations: Approve Ordinance 05-1169 on second and final public hearing. Audience InDut: (Comments made by John Casselberry, 700 S. Lost Lake Lane, Casselberry, Florida, speaking as a citizen with interest in Casselberry Investment, Ltd., voiced concerns with the future land use amendment and the rezoning in the Westside Plan asked ifCIP had been notified. Ms. Smith stated that she had met with Ms. Lilian Selph ofCIP Investments and she expressed no objections to the rezoning. MOTION: Moved by Commissioner Susan Doerner to approve Ordinance 05-1169, Westside Area Future Land Use Map Amendment (LP A 05-07) as presented on second reading. The motion was seconded by Commissioner Colleen S. Hnfford and carried on a 4 - 1 vote. Commissioner Kathy L. Cook dissenting.
