<br />City Commission Meeting <br />November 14, 2005 <br />Page 3 <br /> <br />Staff Presentation: Ms. Sandra Smith stated thatthe City if administratively amending the Future Land Use <br />Map designation for the City Center Property, a 15.3 acre site located on the southeaster corner of U.S. <br />Highway 17-92 and Triplet Lake Drive. This is a large scale amendment that requires State review before <br />adoption and require two advertised public hearings. The first hearing was approved by the City Commission <br />on March 14, 2005 and then transmitted to the Florida Department of Community Affairs (DCA) for their <br />review. DCA routes the application to the various jurisdiction in the State for their comments. The State's <br />only concern was the objection from the Florida Department of Transportation regarding traffic impacts to <br />the existing roadway network if the properties were developed to their maximum allowable densities. <br />Additional traffic data was provided to FDOT, who revised their comments to DCA stating that the proposed <br />future land use change would not significantly impact the state roadways. <br /> <br />The City Attorney stated that a sign up sheet was provided at the podium for anyone who wants to receive <br />updates on DCA status of the Comprehensive Plan Amendments A, C, D and E . <br /> <br />Staff Recommendation: Approve Ordinance 05-1153 on second and final public hearing. <br /> <br />Andience InDnt: John Casselberry, 700 S. Lost Lake Lane, Casselberry, Florida, restated his objections to <br />the Overlay District and recommended the City do a reappraisal for the property because with competition <br />in the business community, the current use restrictions could potentially devalue the property. He <br />recommended Commission table all the public hearing items until a new appraisal is accomplished. The City <br />Attorney stated that the City has the authority to reasonably restrict uses of property and delaying the issue <br />was not necessary. <br /> <br />MOTION: <br /> <br />Moved by Commissioner Colleen S. Hufford to approve Ordinance 05-1153, <br />City Center Future Land Use Map Amendment (LPA 05-01), as presented on <br />second reading. The motion was seconded by Commissioner Susan Doerner <br />and carried unanimonsly by voice vote. (5 - 0) <br /> <br />B. Public Hearing and Second Reading of Ordinance 05-1 154 - City Center Rezoning Amendment- <br />Southeastern Corner of U.S. Hwv 17-92 and Triplet Lake Drive (ZB 05-01) <br /> <br />The City Clerk read Ordinance 05-1 154 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING <br />THE CITY OF CASSELBERRY OFFICIAL ZONING MAP AS EST ABLlSHED IN <br />ARTICLE IV, SECTION 2-4.3, UNIFIED LAND DEVELOPMENT REGULATIONS <br />OF THE CITY OF CASSELBERRY, FLORIDA, AS AMENDED AND <br />SUPPLEMENTED; ESTABLISHING THE ZONING CLASSIFICATION OF PMX-H <br />(PLANNED MIXED USE; HIGH INTENSITY) FOR THOSE PARCELS <br />DESCRIBED IN SECTION 1 OF THIS ORDINANCE; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE." <br /> <br />Le!!al Advertisement: The notice for the second public hearing for Ordinance 05-1154 was advertised in <br />the Orlando Sentinel on Sunday, October 30, 2005. <br />
