<br />City Commission Meeting <br />October 24, 2005 <br />Page 5 <br /> <br />Drive/Melody Lane Re-alignment. The uses for the other parcels are primarily drainage-related. The <br />contract purchase price of $65,291.00, was negotiated as a package deal for all nine parcels. Funding for <br />this purchase will come from the Infrastructure Surtax Fund (114-0710-541-63.43). <br /> <br />Staff Recommendation: Approve Resolution 05-1628 authorizing contract for purchase nine (9) parcels of <br />land from Casselberry Investment Properties, Ltd. (CIP). <br /> <br />Audience Input: John Casselberry, 700 S. Lost Lake Lane, Casselberry, Florida, as a private citizen and as <br />a person having a beneficial interest in Casselberry Investment Properties, Ltd., spoke in opposition to the <br />City's purchase of the nine parcels because the parcels had been undervalued and CIP had been misled <br />regarding the development ofthe land. He enumerated several other concerns regarding the purchase ofthe <br />nine parcels and requested Commission table action on the item until the next Commission meeting. <br /> <br />Mr. Segreto stated that the City had negotiated with Casselberry Investment Properties, Ltd., in good faith <br />for over two years and the contract submitted to Commission was fair and equitable to CIP as well as being <br />beneficial to the City regarding stated road re-alignments and storm water retention. <br /> <br />MOTION: <br /> <br />Moved by Commissioner Colleen S. Hufford to approve Resolution 05-1628, <br />authorizing purchase of nine (9) parcels ofIand from Casselberry Investment <br />Properties, Ltd., as presented. The motion was secouded by Commissioner <br />Susan Doerner and carried unanimously by voice vote. (5 - 0) <br /> <br />D. Resolution 05-1629 - Adoption of Seminole County's Sexual Predator Ordinance <br /> <br />The City Clerk read Resolution 05-1629 by title as follows: <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, REQUESTING <br />ENFORCEMENT OF SEMINOLE COUNTY'S SEXUAL PREDATOR ORDINANCE <br />NO. 2005-41 WITHIN THE CITY LIMITS OF CASSELBERRY; REPEALING ANY <br />INCONSISTENT ORDINANCES; PROVIDING FOR AN EFFECTIVE DATE;" <br /> <br />Staff Presentation: Mr. Segreto presented Resolution 05-1629 that would adopt and enforce Seminole <br />County Sexual Predator Ordinance 2005-41 enacted by the County Commissioners September 27,2005. <br />He also indicated that the State was having hearings to develop some statewide regulations regarding sexual <br />predators that would negate the need for each county having separate regulations. <br /> <br />Attornev Recommendation: Adopt Resolution 05-1629, requesting enforcement of Seminole County's <br />Sexual Predator Ordinance 2005-41. She indicated that the County Ordinance would be enforceable within <br />the City regardless of actions by the City. (Seminole County Code Section \.5) She stated that since this <br />ordinance had not been tested in Court, this action would be a stopgap measure until the State develops <br />statewide regulations. <br /> <br />Police Chief Recommendation: Chief Pavlis stated the County ordinance was problematic and from a law <br />enforcement prospective he would recommended the Commission delay action until the State has addressed <br />this issue. <br />
