SECTION FOUR. Waiver of Fees. A waiver of the application fee may be approved by the City Commission for public, semi-public and not-for-profit entities performing administrative services as defmed by S. 5-21.2 of the Unified Land Development Regulations. Fee waiver applications, including a demonstration of need for the fee waiver, shall be submitted to the Community Development Director, who shall forward it with a recommendation for action by the City Commission. For applications where the City of Casselberry is the property owner and the applicant, the fees shall be automatically waived. SECTION FIVE. Refund of Fees. Fee payments may be refunded, at the discretion of the Community Development Director, upon withdrawal of the application at the request of the applicant, if such application is withdrawn prior to consideration by the Development Review Committee. SECTION SIX. Continuance of Force. The fee schedule established by this resolution shall remain in full force and effect, as amended from time to time by Resolution. SECTION SEVEN. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION EIGHT. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION NINE. Effective Date. This Resolution shall become effective immediately upon its passage and adoption.
