<br />CASSELBERRY CITY COMMISSION <br />Minutes of September 26, 2005 ~ Regular Meeting <br />Page 5 oflO <br /> <br />Legal Advertising: The notice of public hearing relative to Ordinance 05-1171 was published in tbe Orlando <br />Sentinel on September 16, 2005. <br /> <br />Staff Presentation: Mr. Goucher stated Ordinance 05-1171 provides for mandatory connection to the <br />sanitary sewer system within one year of its becoming available. The ordinance also revises the "septic tank <br />exception" to apply only to single family properties, and provides for a reduced connection charge of <br />$450.00. Staff recommended approval of Ordinance 05-1171 on second reading. <br /> <br />Public Hearing: One (I) audience comment request form was received for Ordinance 05-1171. The <br />following individual came forward: <br /> <br />I) John Casselberry, 700 South Lost Lake Lane, spoke in opposition to Ordinance 05-1171. <br /> <br />Mayor Goff closed the public hearing. <br /> <br />MOTION: Commissioner Doerner moved to approve Ordinance <br />05-1171 as presented. Motion was seconded by Vice <br />Mayor Hart. <br /> <br />DISCUSSION: Commissioner Cook voiced concerns regarding the previous removal ofthe <br />code section that allowed for flowby charges to be fully applied toward <br />connection fees. Mr. Segreto stated that section of the code was removed <br />because the City's accounting system had a difficult time tracking those <br />fees. Commissioner Cook stated the citizens should not be punished for the <br />failure in the accounting system and stated if a citizen can document what <br />they have paid in flowby and that they were under the original code, it <br />should be fully credited to their connection fee. Mr. Segreto stated citizens <br />will be given credit for the entire reduced connection fee of $450 if they <br />can document what they have paid in flowby charges. <br /> <br />Motion carried unanimously by voice vote. <br /> <br />9.
