<br />SECTION I. Leaislative FindinaslPurDose. The above recitals are hereby incorporated into this <br />Subsection as legislative findings and represent the intent of the City Commission in enacting this <br />Ordinance. <br /> <br />SECTION II. In addition to, and supplemental to, all the City of Casselberry Code of Ordinances <br />heretofore and hereafter established, there is hereby created a future land use map overlay classification <br />known as the "Community Redevelopment District" (CRD). The legal description of the property subject to <br />this overlay is attached hereto as "Exhibit A.". <br /> <br />SECTION III. Property located within the area described in "Exhibit A" shall be subject to all <br />provisions of the "Community Redevelopment District Overlay". This Ordinance shall be in addition to and <br />shall overlay all other zoning and future land use classifications where it is applied, so that any parcel of <br />land lying in the area described in "Exhibit A" shall also lie within one or more of the zoning and future land <br />use classifications provided in the Unified Land Development Regulations and Comprehensive Plan. The <br />effect shall be the creation of supplemental zoning and future land use classifications consisting of the <br />regulations and requirements to both the underlying classifications. <br /> <br />SECTION IV. That the Future Land Use Map established in Chapter II, Article IV, Section 2-4.2 of <br />the Unified Land Development Regulations of the Code of Ordinances of the City of Casselberry, Florida, <br />as amended and supplemented, for the property located within "Exhibit A" is hereby amended and given <br />the CRD future land use overlay classification. That classification is defined in Section III of this Ordinance. <br /> <br />SECTION V. Severability. If any Section or portion of a Section of this Ordinance proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of <br />any other Section or part of this Ordinance. <br /> <br />SECTION VI. Codification. It is the intention of the City Commission of the City of Casselberry, <br />Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of <br />the Code of Ordinance of the City of Casselberry, Florida; that the Sections of this Ordinance may be <br />renumbered or re-Iettered to accomplish such intention; that the word, "Ordinance" may be changed to <br />"Section," "Article," or other appropriate word. <br /> <br />SECTION VII. Conflicts. All Ordinances or parts of Ordinances in conflict with any of the <br />provisions of this Ordinance are hereby also repealed. <br /> <br />SECTION VIII. Effective Date. The effective date of this plan amendment shall be the date a <br />final order is issued by the Department of Community Affairs or Administration Commission finding the <br />amendment in compliance in accordance with Section 163.3184, Florida Statutes, whichever occurs earlier. <br />After and from the effective date of this amendment, the comprehensive plan amendments stated in <br />Section I of this Ordinance shall amend the 2001 Comprehensive Plan and become part of the plan and the <br />plan amendments shall retain the legal status of the 2001 City of Casselberry Comprehensive Plan, as <br />amended. <br /> <br />City of Casselberry, Florida <br />Ordinance No. 05-1156 <br />Page 3 of 4 <br />
