RESOLUTION 03-1396 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXECUTION OF AN AMENDMENT TO THE AGREEMENT FOR RESIDENTIAL SOLID WASTE AND RECYCLING COLLECTION SERVICES WITH REPUBLIC SERVICES, INC; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, the City of Casselberry provides solid waste services for its residents through a contract with Republic Services, Inc.; and WHEREAS, the City staff and Republic Services have negotiated to amend the solid waste service agreement consistent with the Solid Waste Management Act; and WHEREAS, in all other respects the current contract between the City and Republic Services, Inc., dated December 27,2001, remains unchanged. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the First Amendment to the agreement with Republic Services, Inc (attached as "Exhibit A"), and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION ill. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. immediately upon its passage and adoption. PASSED and ADOPTED this ì -) ~ day of This Resolution shall become effective , AD 2003.
