<br />City Commission Meeting <br />June 13, 2005 <br />Page 10 <br />The property is currently vacant, adjacent to the City limits and will not create an enclave. The properties <br />meet the criteria for annexation as established in Chapter 171, Florida Statutes. Ordinance 05-1163 is <br />presented on first reading and approval for advertisement for the final Public Hearing. <br /> <br />Audience Innut: <br /> <br />I) Bernard Fudim, 906 Niblick Drive, Casselberry, Florida, recommended this annexation be delayed <br />until the new City Manager is on board. <br /> <br />MOTION; <br /> <br />Moved by Commissioner Susan Doerner to approve Ordinance 05-1163, BICH <br />Annexation, as presented. The motion was seconded by Commissioner Colleen <br />Hufford and carried unanimously by voice vote. (5 - 0) <br /> <br />The final Public Hearing will be advertised for the July 25, 2005 Meeting. <br /> <br />Recess at 9:35/1.m.: reconvened at 9:45 /1.m. <br /> <br />D. Public Hearinl! and First Readinl! of Ordinance 05-1164 - Accessorv Structures <br /> <br />The City Clerk read Ordinance 06-1164 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING <br />SECTION 2-7.9, ACCESSORY STRUCTURES, PART III, UNIFIED LAND <br />DEVELOPMENT REGULATIONS TO ALLOW TENT-LIKE STRUCTURES AS <br />ACCESSORY STRUCTURES IF THEY MEET CERTAIN CRITERIA; ADDING <br />DEFINITIONS TO SECTION 5-21.2, DEFINITION OF TERMS FOR "BACK <br />YARD" AND "TENT-LIKE STRUCTURE"; PROVIDING FOR SEVERABILITY, <br />CODIFICATION, CONFLICTS, AND EFFECTIVE DATE." <br /> <br />Staff PresentationlRecommendation: <br /> <br />Mr. Wells stated that Ordinance 05-1164 was referred back to the Planning and Zoning Commission after <br />being defeated by the City Commission to re-address the Code to allow "tent-like structures" in rear yards. <br />On a unanimous recommendation, the Planning and Zoning Commission suggested the following changes <br />to Ordinance 05-1164: <br /> <br />· <br /> <br />Allows permanent use of tent-like structures in the rear yard when properly permitted and screened_ <br />Provides criteria that differentiate between a temporary structure and a permanent structure. A <br />permanent structure is one that will be used for more than 35 days. <br />Re-organized the remaining Code into specific types of structures (less that 160 square feet, 160 <br />square feet to 500 square feet, greater that 500 square feet, detached carports, tent-like structures). <br />Grouped similar criteria provided throughout the code for various structure types under one heading, <br />"Genera) Requirements". <br />Added definitions to Article XXI for "Tent-like structure" and "Back Yard". <br /> <br />· <br /> <br />· <br />
