<br />ARTICLE 5 <br />GRIEVANCE PROCEDURE <br /> <br />5.1 The purpose of this Article is to establish machinery for the fair, expeditious, and orderly <br />adjustment of grievances regarding the interpretation or application of this Agreement, including <br />disciplinary actions. <br /> <br />5.2 Any formal grievance filed shall be in writing, shall set forth the provision or provisions of the <br />Agreement alleged to have been violated, the facts pertaining to the alleged violation(s), the date ofthe <br />violation, and the remedy requested. The grievance shall be signed and dated by the grievant. <br />Grievances submitted which do not contain the above information and are incomplete shall be amended <br />by the grievant to state the required information. The necessity of filing an amendment shall not affect <br />the timeliness to the extent that the grievance is substantially complete. <br /> <br />5.3 Grievance discussions at Step One will be conducted during the aggrieved's normal duty hours. <br />The aggrieved employee shall suffer no loss of payor benefits for time required for such meetings. <br /> <br />5.4 Nothing in this section shall be construed to prevent an employee from presenting, at anytime, <br />his/her own grievance without representation, through Step Two. <br /> <br />5.5 An employee who wishes to submit a grievance must submit a grievance in writing within ten <br />(10) working days after the occurrence of the matter from which the grievance arose. A grievance not <br />appealed to the next step within the time limits established by this procedure shall be considered settled <br />on the basis of the last answer provided by management. A grievance not answered within the time <br />limits prescribed for the appropriate management representative at each step shall automatically be <br />advanced to the next step except those grievances reaching or originating at Step Two. The time limits <br />herein may be extended by written mutual agreement of the parties. <br /> <br />5.6 In advancing grievances, the grievant, employee(s), and management may call a reasonable <br />number of witnesses to offer testimony. Either party may call witnesses as needed. Hearings shall be <br />continued to facilitate appearance of witnesses who are department employees and whose presence <br />would otherwise conflict department needs. <br /> <br />5.7 The formal grievance steps are as follows: <br /> <br />Step One <br /> <br />The employee(s) shall file the grievance, in writing, within ten (10) working days of the occurrence of <br />the event giving rise to the grievance of the matter to the department head. <br /> <br />The department head shall make a decision and communicate it to the employee and the Union in writing <br />within ten (10) working days from the date the grievance was received or conference held. <br /> <br />T/A'd Contract <br /> <br />-7- <br />
