<br />Step Two <br /> <br />If the grievance is not resolved to the grievances satisfaction as rendered by Step One, the employee <br />and/or Union may forward the grievance, in writing, to the City Manager within ten (10) calendar days of <br />receiving notification from the department head. <br /> <br />The City Manager, or his/her designee, will conduct a meeting within ten (10) working days with the <br />grievant unless the department head chooses to grant the requested relief without further proceedings. <br />The grievant shall not be represented by an elected official ofthe City, the City Attorney or his/her staff, <br />or a person affiliated with a Union other than the certified bargaining agent. The City Manager, or <br />his/her designee, shall notifY the employee and the Union of his /her or her decision, in writing, within <br />ten (10) working days after the meeting date. <br /> <br />5.8 All disciplinary grievance will initially be filed at the step above the level at which the discipline <br />was initiated. All class action grievances will be filed at Step Two. <br /> <br />5.9 The aggrieved employee and the Union shall be given at least two (2) work days notice of the <br />Grievance meetings provided herein. <br /> <br />5.10 If any grievance not relating to discipline or discharge is not satisfactorily resolved by the <br />foregoing procedure, the Union may proceed to arbitration according to Article 6. With respect to <br />disciplinary actions, the Union may proceed to arbitration according to Article 6 only for unpaid <br />disciplinary suspensions greater than five days' duration or for termination. <br /> <br />T/A'd Contract <br /> <br />-8- <br />
