<br />City Commission Meeting <br />April 11, 1005 <br />Page 7 <br /> <br />Commissioner Cook spoke in opposition to Ordinance 05-1158, stating that canopies were not blight, this <br />issue was strictly for aesthetics and passage of this ordinance would deprive citizens the right to utilize their <br />property the way they would like. The City could impose restrictions use and proper installation, more <br />restrictive rules should come from homeowners association groups. <br /> <br />Commissioner Doerner spoke in favor of Ordinance 05-1158, stating that Casselberry had come a long way <br />in upgrading its image from all night bars and adult entertainment establishments. Ordinance 05-1158 <br />encourages citizens to invest in their property and that enhances the aesthetics in their community. She <br />indicated that this issue could be a good candidate for a referendum to let the citizens decide on the direction <br />that should be taken by the Commission. <br /> <br />Mayor Goff discussed a chart he distributed that was compiled from information received from the Seminole <br />County Property Appraiser. The chart breaks down Casselberry housing stock that shows the appreciation <br />of housing in the City of Casselberry. (Chart is attached to an made a part of these minutes.) Mayor Goff <br />was opposed to Ordinance 05-1158 stating that it was invasive to the public's right to enjoy their property; <br />canopies should fall under the purview of the Building Department. <br /> <br />Commissioner Hufford spoke in favor of Ordinance 05-1158 and the City has come a long way in the last ten <br />years and having good value in your home is a basic right. Canopies and tent-like structures in a community <br />are not safe, not aesthetically pleasing and they deter people from investing in the community. <br /> <br />Commissioner Hart said she opposed to government telling citizens what they can or cannot do in the privacy <br />of their own backyard and canopies/ tent-like structures with proper installation and permits from the Building <br />Department should be considered. Commission Hart stated further review regarding permitting of canopies <br />where they are not visible from the street and have no affect on curb appeal. Commissioner Hart also <br />concurred with Commissioner Doerner and this issue be considered on a referendum to allow the residents <br />to decide on the direction Commission should take. <br /> <br />VOTE ON THE MOTION: Commissioner Doerner - Yes; Commissioner Cook - No; <br />Commissioner Hufford - Yes; Commissioner Hart - No; <br />Mayor Goff - No <br /> <br />MOTION Denied on 3 - 2 Vote <br /> <br />MOTION: <br /> <br />Moved by Commissioner Linda Hart that Ordinance 05-1158 be deferred back <br />to Planning and Zoning Commission for further review and any further criteria <br />regarding out-of- site canopies or tent-like strnctures. The motion was <br />seconded by Commissioner Kathy Cook. <br /> <br />VOTE ON THE MOTION: Commissioner Doerner - No; Commissioner Cook - Yes; <br />Commissioner Hufford - No; Commissioner Hart - Yes; <br />Mayor Goff - Yes <br /> <br />MOTION Passed on 3 - 2 Vote <br />
