<br />CASSELBERRY CITY COMMISSION <br />Minutes of March 14, 2005 - Regular Meeting <br />Page-70f19 <br /> <br />MOTION: <br /> <br />Vice Mayor Hart moved to approve Ordinance 05-1152 <br />on first reading. Motion was seconded by <br />Commissioner Cook. <br /> <br />Discussion on Motion: Commissioner Doerner voiced concerns regarding utilizing the de novo process for <br />the appeals. Discussion ensued regarding the two processes. Mr. Clifton <br />recommended changing the process to writ of certiorari. Mrs. Reischmann stated <br />if the de novo process was changed to writ of certiorari it would require Ordinance <br />05-1152 to have another advertised first reading and public hearing. <br /> <br />MOTION: <br /> <br />Commissioner Doerner moved to amend Ordinance 05- <br />1152 to utilize the writ of certiorari process instead of <br />the de novo process. Motion was seconded by <br />Commissioner Hufford. <br /> <br />Discussion on Motiou: Mayor Goff stated he was in favor of the de novo process and would be voting <br />against the amendment to Ordinance 05-1152. <br /> <br />Motion to amend Ordinance 05-1152 was denied 1- 4 <br />(Mayor Goff, Vice Mayor Hart, Commissioner Cook, <br />and Commissioner Hufford dissenting) by voice vote. <br /> <br />Motion to approve Ordinance 05-1152 on first reading <br />as presented carried 3 - 2 (Commissioner Doerner and <br />Commissioner Hufford dissenting) by voice vote. <br /> <br />Next Public Hearing Date: The second reading and public hearing for Ordinance 05-1152 is scheduled for <br />April 11, 2005. <br /> <br />C. PUBLIC HEARING & FIRST READING OF ORDINANCE 05-1153 - FUTURE <br />LAND USE MAP AMENDMENT LPA 05-01 - SOUTHEASTERN CORNER OF <br />U.S. HIGHWAY 17-92 AND TRIPLET LAKE DRIVE <br /> <br />The City Clerk read Ordinance 05-1153 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE <br />CITY OF CASSELBERRY COMPREHENSIVE PLAN BY AMENDING THE OFFICIAL <br />FUTURE LAND USE MAP, ESTABLISHING THE FUTURE LAND USE <br />DESIGNATION OF HIGH INTENSITY NON-RESIDENTIAL/MEDIUM DENSITY <br />RESIDENTIAL (HINRIMDR) FOR THOSE PARCELS DESCRIBED IN SECTION I OF <br />THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN <br />EFFECTIVE DATE." <br />
