<br />CASSELBERRY CITY COMMISSION <br />Minutes of March 14~ 2005 - Regular Meeting <br />Page 18 of]9 <br /> <br />Vice Mayor Linda Hart - Seat #3: <br /> <br />· Noted the existing Summerset North subdivision wall was in the process of being demolished and <br />temporary fencing was being installed until the new wall is built. <br /> <br />Mayor Bob Goff - Seat #5: <br /> <br />· Requested a clarification from the City Attorney regarding City Commission Members attendance <br />at advisory board meetings, specifically asking if it was okay for two or members of the City <br />Commission to attend as long as they do not talk at the meeting. Mrs. Reischrnann stated it would <br />be okay so long as the City posts notice that City Commissioners may be attending, but stressed it <br />can create an issue if it's a quasi-judicial matter that might come before the City Commission. <br />Mayor Goff asked what was the difference between attending the meeting and listening to the tapes <br />of the meeting, or reacting the minutes from a meeting. Mrs. Reischmann stated minutes would come <br />to all City Commissioners as part of the agenda materials for a quasi-judicial proceeding and would <br />not be considered a due process issue. Mrs. Reischmann further stated that if a Commissioner were <br />in attendance at an advisory board meeting, they would have more information than the rest of the <br />City Commission and it could give an appearance of pre judgement before the hearing. Mayor Goff <br />stated he disagreed with Mrs. Reischmann's opinion on the matter, and further stated that the <br />additional notice needed to be added to advisory board agendas because he does not intend to stop <br />attending advisory board meetings. <br /> <br />XII. STAFF REPORTS <br /> <br />Frank W. Clifton, Jr. - City Manager: <br /> <br />· Reported he will be out of town March 19 through March 27, 2005 and that Mr. Segreto will serve <br />as Acting City Manager during his absence. <br />· Distributed the tentative budget schedule and requested the City Commission to review the proposed <br />dates. The schedule will be placed on a future agenda for formal consideration by the City <br />Commission. <br />· Distributed a comparison of garbage rates for the area, noting the City of Casselberry had the lowest <br />rate in Seminole County. <br />· Suggested the City Commission consider sending a position statement to the City's federal <br />legislative delegation opposing President Bush's proposal to eliminate the Community Development <br />Block Grant Program. Commission consensus was to send a letter to the federal legislative <br />delegation opposing the elimination of the Community Development Block Grant Program. <br /> <br />Catherine Reischmann - City Attorney: <br /> <br />Reported Seminole County is opposed to the City filing an Amicus Brief for the City of Winter <br />Spring's legal challenge to the Seminole County Charter Amendment on the Rural Boundary because <br />they felt the City would be recanting the dispute resolution procedure. Noted the Florida League of <br />Cities is filing an Amicus Brief in the case on the same issue that the City Commission previously <br />based its decision on, and suggested as an alternative that the City file an Amicus Brief adopting the <br />
