<br />CASSELBERRY CITY COMMISSION <br />Minutes of March 14,2005 - Regular Meeting <br />Page I2 of 19 <br /> <br />Public Hearing: No audience comment request forms were received for Ordinance 05-1158. Mayor Goff <br />closed the public hearing. <br /> <br />MOTION: <br /> <br />Commissioner Hufford moved to approve Ordinance <br />05-1158 on first reading, as presented. Motion was <br />seconded by Commissioner Doerner. <br /> <br />Discussion on Motion: Mrs. Reischmann requested the following scrivener's error be corrected on page 2 <br />of Ordinance 05-1158: <br /> <br />"Canopies. A temporary or semi-permanent shelter or decorative device or <br />covering, either jùlly enclosed or not CO"'l':"t.:d comnletelv enclosed....." <br /> <br />AMENDED MOTION: <br /> <br />Commissioner Hufford moved to <br />approve Ordinance 05-1158 ou first <br />reading as amended. Motion was <br />seconded by Commissioner Doerner. <br /> <br />Discussion on Motion: Commissioner Cook stated she would be voting against Ordinance 05-1158 because <br />she was not opposed to canopies and tent-like structures being utilized by citizens. <br />Commissioner Cook voiced concerns regarding selective code enforcement and <br />stripping citizens of property rights. <br /> <br />Lengthy discussion ensued regarding the administrative process for issuing permits <br />for tents, canopies, and tent-like structures. The Building Division will require <br />permits for all such structures, both temporary and permanent. If the structure is <br />permanent, it will be required to meet all necessary zoning and building codes. If <br />the structure is temporary, the applicant will declare the use for the temporary <br />structure, and the use will be tied to the structure's removal date in the permit. The <br />longest period for which a temporary tent, tent-like structure or canopy is typically <br />needed is for seasonal sales (Christmas trees, fireworks, etc.), and the code allows <br />35 days per year for such events. It was suggested that the temporary structure <br />permit for any purpose will not be approved for more than 35 days in a calendar <br />year and may be renewed once for a total of 70 days under extenuating <br />circumstances with approval of the Administrative Official. This process will give <br />Code Enforcement a defmitive date from which to begin code enforcement <br />proceedings for tent-like structures that remain in place beyond the permitted <br />period. <br /> <br />Mayor Goff voiced concerns regarding various swings and gazebo structures that <br />can be purchased ,and whether or not they will be prohibited by Ordinance 05-1158. <br />Mayor Goff also voiced concerns with the affect on property rights. <br /> <br />Motion carried 3 - 2 (Mayor Goff and Commissioner Cook dissenting.) <br /> <br />Next Public Hearing: The second reading and public hearing for Ordinance 05-1158 is scheduled for April <br />11,2005. <br />
