Box 4848 <br />Sanford, FL 32772-4848 <br /> <br />"ATTACHMENT A" <br /> <br />UTILITY COMMITMENT AGREEMENT <br /> <br />THIS UTILITY COMMITMENT AGREEMENT ("Agreement") is made this '2 day of /r,¡ifd , <br />2005, between John M. Hartman, whose address is 995 West State Road 434, Winter Springs, Florida 32708 <br />(the "Developer"), and the CITY OF CASSELBERRY, FLORIDA, a Florida municipality, whose address is 95 <br />Tripiet Lake Drive, Casselberry, Florida 32707 (the "City"). <br /> <br />RECITALS <br /> <br />WHEREAS, Developer is the developer of that certain real property located in Casselberry, Florida, <br />more particularly described as set forth on Exhibit "A" attached hereto and incorporated herein by this <br />reference (the "Property"); <br /> <br />WHEREAS, Developer desires to develop the Property for use as three single family residential lots <br />(the "Project"); <br /> <br />WHEREAS, the City is authorized to regulate the development of the Property; <br /> <br />WHEREAS, Developer has agreed to build and permit an oversized wastewater pumping station, <br />related sanitary sewer system and water main with fire hydrant subject to partial reimbursement by the City for <br />the excess capacity, and the Developer and the City desire to set forth and memortalize the various condttions, <br />development standards and other obligations imposed by the City and other conditions applicable to the <br />proposed development of the Property; and <br /> <br />WHEREAS, this Agreement is consistent with the City's Comprehensive Plan. <br /> <br />NOW THEREFORE, in consideration of the above premises, the promises and provisions contained <br />herein and other good and valuable consideration, the receipt and sufficiency of which is hereby <br />acknowledged, the City and Developer agree as follows: <br /> <br />1. Incorooration of Recitals. The foregoing recitals shall be and are hereby incorporated into and <br />made a part of this Agreement. <br /> <br />1 <br />
