Box 4848 Sanford, FL 32772-4848 "ATTACHMENT A" UTILITY COMMITMENT AGREEMENT THIS UTILITY COMMITMENT AGREEMENT ("Agreement") is made this '2 day of /r,¡ifd , 2005, between John M. Hartman, whose address is 995 West State Road 434, Winter Springs, Florida 32708 (the "Developer"), and the CITY OF CASSELBERRY, FLORIDA, a Florida municipality, whose address is 95 Tripiet Lake Drive, Casselberry, Florida 32707 (the "City"). RECITALS WHEREAS, Developer is the developer of that certain real property located in Casselberry, Florida, more particularly described as set forth on Exhibit "A" attached hereto and incorporated herein by this reference (the "Property"); WHEREAS, Developer desires to develop the Property for use as three single family residential lots (the "Project"); WHEREAS, the City is authorized to regulate the development of the Property; WHEREAS, Developer has agreed to build and permit an oversized wastewater pumping station, related sanitary sewer system and water main with fire hydrant subject to partial reimbursement by the City for the excess capacity, and the Developer and the City desire to set forth and memortalize the various condttions, development standards and other obligations imposed by the City and other conditions applicable to the proposed development of the Property; and WHEREAS, this Agreement is consistent with the City's Comprehensive Plan. NOW THEREFORE, in consideration of the above premises, the promises and provisions contained herein and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the City and Developer agree as follows: 1. Incorooration of Recitals. The foregoing recitals shall be and are hereby incorporated into and made a part of this Agreement. 1
