<br />RESOLUTION 05-1564 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF AN AGREEMENT WITH JOHN M. HARTMAN FOR PARTIAL <br />REIMBURSEMENT OF THE COST FOR CONSTRUCTION OF UTILITY SYSTEMS TO <br />SERVE FUTURE CONNECTIONS; PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE." <br /> <br />WHEREAS, John M. Hartman has purchased a parcel of land which he intends to divide into <br />three single family residential lots; and <br /> <br />WHEREAS. John M. Hartman has annexed said parcel into the City of Casselberry; and <br /> <br />WHEREAS, said parcel is located on a private road in unincorporated Seminole County known <br />as Marion Lane containing other single family residential lots and varied businesses currently on <br />wells and septic tanks; and <br /> <br />WHEREAS, John M. Hartman has agreed to permit and build an oversized wastewater <br />pumping station, related sanitary sewer system and a water main with fire hydrant that would have <br />sufficient capacity to serve the other residences and businesses on and near Marion Lane based on <br />a prorated reimbursement from the City of Casselberry for that capacity in excess of that required <br />for Mr. Hartman's three lots; and <br /> <br />WHEREAS, the City staff has reviewed the construction cost, pro rata calculations and <br />proposed Utility Commitment Agreement and recommends that the City of Casselberry enter into said <br />Agreement. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry hereby approves the Utility <br />Commitment Agreement with John M. Hartman (attached hereto as "Attachment A"), and authorizes <br />the Mayor to execute said document on behalf of the City. <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br /> <br />SECTION III. Severabilitv. If any Section or portion of a Section of this Resolution proves to <br />be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or <br />effect of any other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date.
