CASSELBERRY CITY COMMISSION Minutes of February 28, 2005 - Executive Session & Regular Meeting Page 8 of 14 remain in Northland Church's ownership with proposed future development to include a sanctuary, an international school, apartments for students, a park and small commerciallbusiness area. The plat includes Tract A which is the stormwater retention area to be owned by Northland Church and maintained by the master association, Legacy Park. Centex Homes and Northland are joint members ofthe master association, and they have an agreement to that affect. The Planning & Zoning Commission recommended approval of SP 04-05 on October 27, 2004. The City Attorney has reviewed and approved the replat and title certifiation. The City Surveyor has reviewed and approved the plat in accordance with Chapter 177 of the Florida Statutes. The applicant has met all conditions except those required for the recording of the plat. Those conditions will be met by the applicant upon final approval by the City Commission and prior to recording of the documents. Staff recommended approval of SP 04-05 subject to the following conditions: I. The mylar shall include references to Plat Book and Page Numbers, as appropriate, and it shall be fully executed. 2. The applicant, per Chapter 177 of the Florida Statutes, is repsonsible for the City Surveyor's fees. Prior to recording the replat, the applicant shall submit a check made payable to the City of Caselberry to cover all City Surveyor's fees. 3. After City Commission approval, the applicant shall provide the City with a check for the recording fees made payable to Clerk of the Court for recording of the executed mylars. Audience Participation: One (1) audience comment request form was received for SP 04-05 from the following individual: I) John Casselberry, 700 South Lost Lake Lane, voiced concerns regarding corporate certificates, signature verification methods relating to title certification, and drainage issues relating to the subject properties. MOTION: Commissioner Doerner moved to approve SP 04-05, Replat of Legacy Park, subject to the three conditions outlined in these minutes. Motion was seconded by Commissioner Hufford. Motion carried unanimously by voice vote. D. RESOLUTION05-1561-EMERGENCYWATERSUPPLY AGREEMENT WITH ZEPHYRHILLS CORPORATION The City Clerk read Resolution 05-1561 by title as follows: "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING ZEPHYRHILLS CORPORATION TO PROVIDE EMERGENCY WATER; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE."
