<br />CASSELBERRY CITY COMMISSION <br />Minutes of February 28, 2005 - Executive Session & Regular Meeting <br />Page 8 of 14 <br /> <br />remain in Northland Church's ownership with proposed future development to include a sanctuary, an <br />international school, apartments for students, a park and small commerciallbusiness area. The plat includes <br />Tract A which is the stormwater retention area to be owned by Northland Church and maintained by the <br />master association, Legacy Park. Centex Homes and Northland are joint members ofthe master association, <br />and they have an agreement to that affect. The Planning & Zoning Commission recommended approval of <br />SP 04-05 on October 27, 2004. The City Attorney has reviewed and approved the replat and title certifiation. <br />The City Surveyor has reviewed and approved the plat in accordance with Chapter 177 of the Florida <br />Statutes. The applicant has met all conditions except those required for the recording of the plat. Those <br />conditions will be met by the applicant upon final approval by the City Commission and prior to recording <br />of the documents. Staff recommended approval of SP 04-05 subject to the following conditions: <br /> <br />I. The mylar shall include references to Plat Book and Page Numbers, as appropriate, and it <br />shall be fully executed. <br /> <br />2. The applicant, per Chapter 177 of the Florida Statutes, is repsonsible for the City Surveyor's <br />fees. Prior to recording the replat, the applicant shall submit a check made payable to the <br />City of Caselberry to cover all City Surveyor's fees. <br /> <br />3. After City Commission approval, the applicant shall provide the City with a check for the <br />recording fees made payable to Clerk of the Court for recording of the executed mylars. <br /> <br />Audience Participation: One (1) audience comment request form was received for SP 04-05 from the <br />following individual: <br /> <br />I) John Casselberry, 700 South Lost Lake Lane, voiced concerns regarding corporate <br />certificates, signature verification methods relating to title certification, and drainage issues <br />relating to the subject properties. <br /> <br />MOTION: <br /> <br />Commissioner Doerner moved to approve SP 04-05, <br />Replat of Legacy Park, subject to the three conditions <br />outlined in these minutes. Motion was seconded by <br />Commissioner Hufford. Motion carried unanimously <br />by voice vote. <br /> <br />D. RESOLUTION05-1561-EMERGENCYWATERSUPPLY AGREEMENT WITH <br />ZEPHYRHILLS CORPORATION <br /> <br />The City Clerk read Resolution 05-1561 by title as follows: <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING <br />ZEPHYRHILLS CORPORATION TO PROVIDE EMERGENCY WATER; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />
