<br />ORDINANCE NO. 04-1151 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING PART III, ARTICLE X, SUBSECTION (A)(1) OF <br />COMMERCIAL VEHICLES, SECTION 3-10.9 OF THE CASSELBERRY . <br />CODE OF ORDINANCES ENTITLED "PARKING OF VEHICLES W~ <br />RESIDENTIAL DISTRICTS;" ESTABLISHING THE CRITERIA <br />DESIGNATING A COMMERCIAL VEHICLE; CLARIFYING THAT <br />COMMERCIAL VEHICLES OVER 6,000 POUNDS GROSS WEIGHT <br />CANNOT BE PARKED IN RESIDENTIAL AREAS EXCEPT WHEN <br />ACTIVELY ENGAGED IN WORK; CLARIFYING THAT COMMERCIAL <br />VEHICLES UNDER 6,000 POUND GROSS WEIGHT MAY BE PARKED <br />IN RESIDENTIAL DISTRICTS OVERNIGHT; PROHIBITING PARKING <br />OF ANY COMMERCIAL VEHICLE ON ANY CITY RIGHT-OF-WAY <br />UNLESS ACTIVELY ENGAGED IN WORK; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY AND AN EFFECTIVE <br />DATE. <br /> <br />WHEREAS, the City of Casselberry has a specific important governmental <br /> <br />interest in the regulation of commercial vehicles in residential neighborhoods; and <br /> <br />WHEREAS, the City of Casselberry desires to protect its citizens from the noise, <br /> <br /> <br />visual blight and traffic hazards posed by· commercial vehicles in residential <br /> <br />neighborhoods; and <br /> <br />WHEREAS, the City does not want to overly restrict the use of commercial <br /> <br />vehicles by those City of Casselberry residents who use such vehicles in their day-to- <br /> <br />day employment; and <br /> <br />WHEREAS, the City Commission of the City of Casselberry held a duly noticed <br /> <br />public hearing on the proposed change set forth herein and considered advice of staff, <br /> <br />citizens, and all interested parties submitting written and oral comments and supporting <br />
