<br />AS APPROVED ON FIRST READING <br />(NOV. 22, 2004) <br /> <br />ORDINANCE NO. 04-1151 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING PART III, ARTICLE X, SECTION 3-10.9 OF THE <br />CASSELBERRY CODE OF ORDINANCES ENTITLED "PARKING OF <br />VEHICLES IN RESIDENTIAL DISTRICTS;" ESTABLISHING THE <br />CRITERIA DESIGNATING A COMMERCIAL VEHICLE; CLARIFYING <br />THAT COMMERCIAL VEHICLES OVER 6,000 POUNDS GROSS <br />WEIGHT CANNOT BE PARKED IN RESIDENTIAL AREAS EXCEPT <br />WHEN ACTIVELY ENGAGED IN WORK; CLARIFYING THAT <br />COMMERCIAL VEHICLES UNDER 6,000 POUND GROSS WEIGHT <br />MAY BE PARKED IN RESIDENTIAL DISTRICTS OVERNIGHT; <br />PROHIBITING PARKING OF ANY COMMERCIAL VEHICLE ON ANY <br />CITY RIGHT-OF-WAY UNLESS ACTIVELY ENGAGED IN WORK; <br />PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY AND <br />AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City of Casselberry has a specific important governmental <br /> <br />interest in the regulation of commercial vehicles in residential neighborhoods; and <br /> <br />WHEREAS, the City of Casselberry desires to protect its citizens from the noise, <br /> <br />visual blight and traffic hazards posed by commercial vehicles in residential <br /> <br />neighborhoods; and <br /> <br />WHEREAS, the City does not want to overly restrict the use of commercial <br /> <br /> <br />vehicles by those City of Casselberry residents who use such vehicles in their day-to- <br /> <br /> <br />day employment; <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA: <br /> <br />SECTION I: The Code of Ordinances of the City of Casselberry Part III, Article <br />
