PUBLIC HEARING - FIRST READING OF ORDINANCE 04-1151 - REVISION <br />TO SECTION 3-10.9. PARKING OF COMMERCIAL VEHICLES IN <br />RESIDENTIAL DISTRICTS <br /> <br />The City Clerk read Ordinance 04-1151 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING PART <br />Ill, ARTICLE X, SUBSECTION (A)(l) OF COMMERCIAL VEHICLES, SECTION 3-10.9 <br />OF THE CASSELBERRY CODE OF ORDINANCES ENTITLED "PARKING OF <br />VEHICLES IN RESIDENTIAL DISTRICTS;" ESTABLISHING THE CRITERIA <br />DESIGNATING A COMMERCIAL VEHICLE; CLARIFYING THAT COMMERCIAL <br />VEHICLES OVER 6,000 POUNDS GROSS WEIGHT CANNOT BE PARKED IN <br />RESIDENTIAL ARES EXCEPT WHEN ACTIVELY ENGAGED IN WORK; <br />CLARIFYING THAT COMMERCIAL VEHICLES UNDER 6,000 POUNDS GROSS <br />WEIGHT MAY BE PARKED IN RESIDENTIAL DISTRICTS OVERNIGHT; <br />PROHIBITING PARKING OF ANY COMMERCIAL VEHICLE ON ANY CITY RlGHT- <br />OF-WAY UNLESS ACTIVELY ENGAGED IN WORK; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE." <br /> <br />Legal Advertisement: The Notice of Public Hearing relative to Ordinance 04-1151 was published in the <br />Orlando Sentinel on November 11, 2004. <br /> <br />Staff Presentation: Mr. Wells stated Ordinance 04-1151 provides for revisions to Unified Land <br />Development Regulations, Part ill, Article X, Section 3-10.9 as previously requested by the City <br />Commission. The Planning & Zoning Commission unanimously recommended denial of Ordinance 04-1151 <br />at its October 27,2004 meeting. A verbatim transcript ofthis agenda item is attached to and made a part <br />of these minutes. <br /> <br />MOTION: <br /> <br />Commissioner Cook moved to approve Ordinance 04- <br />1151 as presented on first reading. Motion was <br />seconded by Vice Mayor Hart. <br /> <br />Public Hearing: Mrs. McPherson stated she received six audience comment request forms for Ordinance <br />04-1151. The following individuals came forward: <br /> <br />1) Rosemary Stevens, 233 Hill Street, spoke in opposition of Ordinance 04-1151. <br /> <br />2) Paul Kelley, Chairman of the Planning & Zoning Commission, 511 Queens Mirror Circle, <br />spoke in opposition of Ordinance 04-1151. Mr. Kelley stated the Planning & Zoning <br />Commission would like to consider revisions to residential parking in general in the near <br />future. <br /> <br />3) David Henson, Planning & Zoning Commission Member, 233 Bridle Path, spoke in <br />opposition of Ordinance 04-1151. <br />
