<br />(a) Any person who, alone or with others, wilfully or wantonly violates this Chapter shall be <br />guilty of a misdemeanor and shall, upon conviction thereof, be punished by a fine of not <br />less than $50.00 and not more than $200.00, or by imprisonment for a term not <br />exceeding 30 days, or by both such fine and imprisonment. Any person convicted under <br />this Section shall for a period of five years be ineligible for appointment to or employment <br />in a position in the classified service and shall, if an employee of the City, immediateiy <br />forfeit the position held. <br /> <br />(b) The violation of any rule promulgated under this Chapter shall be grounds for punishment <br />as follows: <br /> <br />(1) Suspension, removal, demotion or other disciplinary action against the employee. <br />(2) Forfeiture of salary or wages by the a¡¡¡¡ointin!i aloJlherily City ManaQer. <br />(3) Disqualification of an applicant for a position in the classified service. <br />(4) Refusal of the application of the violator for positions with the classified service for a <br />period of five years from the violation date. <br /> <br />Section 2. <br /> <br />Article II is amended as follows: <br /> <br />ARTICLE II. CIVIL SERVICE BOARD. <br /> <br />Sec. 62.36. Membership; tenm of office. <br /> <br />The Civil Service Board shall be composed of five members appointed as follows: <br /> <br />(a) The members shall be appointed by the City Manager with approval of the City <br />Commission, and shall be qualified electors of the City. They shall not, during the term for <br />which they are appointed, be employed in any manner by the City. <br /> <br />(b) Board members appointed by the City Manager and approved by the City Commission <br />shall be appointed for two-year terms as follows: <br /> <br />(1) Two members shall be appointed in each even-numbered year. <br />(2) Three members shall be appointed in each odd-numbered year. <br /> <br />Sec. 62.37. Vacancies. <br /> <br />(a) When a vacancy occurs in the Civil Service Board, by either the resignation, death or <br />removal of a member, the City Manager shall, within 3() eaYÐ øf s"'Ðh vaÐaREry', subject to <br />the approval of the City Commission, appoint a new member qualifying under Section 62- <br />36. The new member shall fill the unexpired term. If the \'asansy iÐ net fillee within the <br />term Ðpeeifioe, the '¡:Jeaney shall be filles within 1 a days by the City CommiÐÐien. <br /> <br />(b) The Board shall be kept advised as to progress regarding the filling of vacancies. <br /> <br />Sec. 62.38. Removal of members. <br /> <br />The members of the Civil Service Board, by a majority vote, shall have the right to expel any <br />member thereof for malfeasance, misfeasance or nonfeasance in office, subject to de noYo <br />review by the a¡¡¡¡eintin!i a"'therity Citv Manaoer and full appellate review by the City <br />Commission. <br /> <br />9 <br />
