<br />ORDINANCE NO. 04-1129 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING ARTICLE III OF THE CODE OF ORDINANCES ENTITLED <br />"PEDDLERS AND SOLICITORS;" AMENDING DEFINITIONS UNDER <br />SECTION 26-66, AND EXCLUDING FROM THE DEFINITION OF <br />"PEDDLER" OR "SOLICITOR" PERSONS ENGAGED IN THE <br />EXERCISE OF THEIR CONSTITUTIONAL RIGHTS OF FREEDOM OF <br />RELIGION AND SPEECH; AMENDING HOURS OF SOLICITATION TO <br />COMPLY WITH FEDERAL LAW; REQUIRING THAT PEDDLERS AND <br />SOLICITORS OBTAIN OCCUPATIONAL LICENSES IN THE CITY OF <br />CASSELBERRY AND HOME SOLICITATION SALES PERMITS AS <br />REQUIRED BY FLORIDA LAW; CLARIFYING THAT BUSINESSES <br />SHALL BE RESPONSIBLE FOR INSURING THAT ITS AGENTS HAVE <br />VALID SOLICITOR'S PERMITS; PROHIBITING CERTAIN ACTIVITIES <br />OF SOLICITORS AND REQUIRING THAT SUCH PERSONS CARRY <br />SOLICITOR'S PERMITS AND PROPER IDENTIFICATION WHEN <br />SOLICITING; CHANGING TIME FOR EXPIRATION OF SOLICITOR'S <br />PERMITS TO A MAXIMUM OF SIXTY (60) DAYS; PROVIDING FOR <br />CHANGES IN APPLICATION AND PERMITTING FEES AND FOR <br />RENEWAL AND NON-TRANSFERABILITY OF PERMITS; CLARIFYING <br />WHEN A SOLICITOR'S PERMIT CAN BE REVOKED OR DENIED; <br />PROVIDING FOR NOTICE AND HEARING WHEN A SOLICITOR'S <br />PERMIT IS REVOKED AND PROVIDING FOR APPEAL WHEN A <br />PERMIT IS DENIED OR REVOKED; PROHIBITING SOLICITATION BY <br />JUVENILES UNLESS A PERMIT IS SOUGHT AND OBTAINED BY A <br />RESPONSIBLE SPONSOR; PROVIDING FOR PENALTIES; <br />PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY AND <br />AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City of Casselberry has· a specific important governmental <br /> <br />interest in the regulation of door-to-door canvassing where the lawful solicitation of <br /> <br />money is involved; and <br /> <br />WHEREAS, the City of Casselberry desires to protect its citizens from fraudulent <br /> <br />solicitations, crime, and from invasions of privacy; and <br /> <br />WHEREAS, the City has previously adopted Chapter 26, Article III, Peddlers and <br /> <br />Solicitors, of the Code of Ordinances of the City of Casselberry in order to protect its <br />
