<br />City Commission Meeting <br />October 25, 2004 <br />Page 9 <br /> <br />The City Attorney, Katie Reischmann, made the following changes to the contract: <br /> <br />Modified an financial disclosure affidavit of the City, revised affidavit with the Statutes <br />Entitled to remove equipment or personal property before closing <br />. Limit of $1 ,000 on any title correction issues <br />Requires the City to restore the property to its original condition <br /> <br />Staff Recommendation: Approve Resolution 04-1535 as amended by the Attorney. The City Manager <br />said this purchase is an important to the entire project and the City is acquiring it at a good price. <br /> <br />Audience InDut: John Casselberry, 700 Lost Lake Lane, Casselberry, FL, requested a copy ofUnicorp's <br />proof of delivery for RFP. He made several comments and suggested some changes to the Contract. The <br />City Attorney responded to Mr. Casselberry's concerns and she will supply him the requested copies. <br /> <br />MOTION: <br /> <br />Moved by Vice Mayor/Commissioner AI Clark to approve Resolution 04-1535 <br />as modified by the City Attorney. The motion was seconded by Commissioner <br />Susan Doerner and carried on a 4 - 1 vote. Commissioner Cook dissenting. <br /> <br />7. Resolntion 04-1536 - Supplemental Agreement No.3 with TEl (HNTB Corporation) <br />Final Desif:D Enl!ineerinl! Service for North Winter Park Drive <br /> <br />MOTION: <br /> <br />Moved by Vice Mayor/Commissioner AI Clark to read Resolution 04-1536, <br />Supplemental Agreement with TEl, by title only. The motion was scconded by <br />Commissioner Linda Hart and carried unanimously by voice vote. <br /> <br />The City Clerk read Resolution 04-] 536 by title as follows: <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING <br />THE EXECUTION OF SUPPLEMENTAL AGREEMENT NO.3 BETWEEN THE <br />CITY OF CASSELBERRY AND TRANSPORT A TION ENGINEERING,INC. (TEl) <br />FOR FINAL DESIGN ENGINEERING AND PERMITTING SERVICES <br />ASSOCIATED WITH THE REALIGNMENT PLAN FOR NORTH WINTER PARK <br />DRIVE, FROM SEMINOLA BOULEVARD TO S.R. 434; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />Staff Presentation: Mr. Goucher presented a Continuing Services Contract for transportation planning and <br />engineering related projects with Transportation Engineering, Inc (TE]) who has subsequently been bought <br />out by the HNTB Corporation. The Supplemental Agreement #3 from TEl for final design and permitting <br />services is related to the realignment of North Winter Park Drive between Seminola Boulevard and State <br />Road 436. The cost for the Agreement is $378,884.23. The funding for the project is through a loan to be <br />repaid from the Infrastructure Surtax. <br /> <br />Staff Recommendation: Approve Resolution 04-] 536 as presented. <br />
