<br />CASSELBERRY CITY COMMISSION <br />Minutes of August 9, 2004 ~ Regular Meeting <br />Page 8 of 13 <br /> <br />Staff Presentation: Mr. Dreier stated since the adoption of Resolution 04-1484, the City has implemented <br />flexible spending accounts for health and dependent care. Resolution 04-1512 recognizes and adopts the <br />amended Section 125 of the Internal Revenues Service Code and provides for incorporation of the new <br />benefit in the premium only plan. Staff recommended approval of Resolution 04-1512. <br /> <br />Audience Input: <br /> <br />1) John Casselberry, 700 South Lost Lake Lane, inquired if Resolution 04-1512 was <br />addressing any problems the City was currently having with the Internal Revenue Service. <br />Mr. Dreier clarified Resolution 04-1512 related adoption of the Internal Revenue Service <br />Code as it relates to flexible spending accounts for employees on a pretax basis for health <br />and dependent care. <br /> <br />MOTION: <br /> <br />Vice Mayor Clark moved to approve Resolution 04- <br />1512 as presented. Motion was seconded by <br />Commissioner Doerner. Motion carried unanimously <br />by voice vote. <br /> <br />3. RESOLUTION 04-1513 - STATING CITY'S POSITION ON PROPOSED <br />COUNTY CHARTER AMENDMENT <br /> <br />MOTION: <br /> <br />Vice Mayor Clark moved to read Resolution 04-1513 <br />by title only. Motion was seconded by Commissioner <br />Hart. Motion carried unanimously by voice vote. <br /> <br />The City Clerk read Resolution 04-1513 by title as follows: <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, STATING THE <br />CITY'S POSITION ON THE PROPOSED COUNTY CHARTER AMENDMENT; AND <br />PROVIDING FOR AN EFFECTIVE DATE." <br /> <br />Staff Presentation: Mrs. Reischmann distributed revised copies of Resolution 04-1513, to the City <br />Commission which included additional whereas clauses to clarify the City's be1iefthat the proposed charter <br />amendment will affect the home rule authority of the City. Mr. Clifton distributed copies of Seminole <br />County's proposed rural boundary charter amendment and the City of Winter Springs' resolution regarding <br />the County's proposed charter amendment. Resolution 04-1513 objects to the proposed rural boundary <br />charter amendment and requests utilizing a joint planning approach for a solution to the matter. Mrs. <br />Reischmann requested the City Commission consider granting the City Manager authority to take whatever <br />action is necessary including invoking the dispute resolution process or authorizing an injunction action, <br />should the referendum move forward by the Seminole County Board of Commissioners prior to the next City <br />Commission meeting. Mr. Clifton clarified any action taken would be in conjunction with other cities. <br />
