<br />------.--, <br /> <br />CASSELBERRY CITY COMMISSION <br />Minutes of June 28, 2004 - Regular Meeting <br />Page 3 of 12 <br /> <br />The City Clerk read Ordinance 04-1132 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATING TO <br />VOLUNTARY ANNEXATION; MAKING FINDINGS; ANNEXING TO AND <br />INCLUDING WITHIN THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, <br />FLORIDA, CERTAIN LANDS LOCATED IN SECTION 8, TOWNSHIP 21S, RANGE <br />30E; REDEFINING THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, <br />FLORIDA; PROVIDING FOR THE INTERIM PROVISION OF LAND DEVELOPMENT <br />REGULATIONS; PROVIDING THAT CERTAIN COUNTY LICENSEES FOLLOWING <br />THEIR BUSINESS, TRADE OR PROFESSION WITHIN THE LANDS TO BE <br />ANNEXED MAY CONTINUE TO FOLLOW SUCH BUSINESS, TRADE OR <br />PROFESSION THROUGHOUT THE ENTIRE CORPORATE LIMITS WITHOUT THE <br />NECESSITY OF FURTHER QUALlFICATION THEREFORE; PROVIDING THAT <br />EFFECTIVE IN ACCORDANCE WITH LAW, THE LANDS TO BE ANNEXED SHALL <br />BE ASSESSED FORP A YMENT OF MUNICIPAL AD V ALOREMTAXES; DIRECTING <br />THE CITY CLERK TO FILE CERTIFIED COPIES OF THE ORDINANCE WITH THE <br />CLERK OF COURT AND THE SECRETARY OF STATE OF THE STATE OF <br />FLORIDA; AND PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, <br />AND EFFECTIVE DATE." <br /> <br />Legal Advertisement: The Notice of Public Hearing relative to Ordinance 04-1132 was published in the <br />Orlando Sentinel on June 11,2004 and June 18,2004. <br /> <br />Staff Presentation: Mr. Wells stated Ordinance 04-1132 provides for annexation of vacant property at the <br />southeastern corner of Anchor Road and Concord Drive. The property to be annexed comprises <br />approximately 3.18 acres and the owner plans on developing approximately 32,000 square feet of <br />office/warehouse space on the property. The subject property is adjacent to the City limits, will not create <br />an enclave and generally meets the statutory criteria for annexation as established in Chapter 171, Florida <br />Statutes. A Pre-Annexation Agreement prepared by the City Attorney was approved by the City Commission <br />at the May 24, 2004 meeting. Staff recommended approval of Ordinance 04- 1132 on second reading. <br /> <br />Public Hearing: Mayor Pronovost asked if there was anyone in the audience that wished to speak either for <br />or against Ordinance 04-1132. The following individual came forward: <br /> <br />1) John Casselberry, 700 South Lost Lake Lane, spoke in favor of Ordinance 04-1131. <br /> <br />No one else came forward. Mayor Pronovost closed the public hearing. <br /> <br />MOTION: <br /> <br />Vice Mayor Clark moved to approve Ordinance 04- <br />1132 on second and final reading. Motion was <br />seconded by Commissioner Doerner. Motion carried <br />unanimously by roll call vote. <br /> <br />Roll Can Vote ofthe City Commission: <br /> <br />Commissioner Doerner - Yes; Commissioner Cook - Yes; Commissioner Hart - Yes; Vice Mayor <br />Clark - Yes; Mayor Pronovost - Yes. Motion passed 5 - O. <br />
