City Commission Meeting <br />July 14, 2003 <br />Page 6 <br /> <br />Commissioner Kathy Cook questioned thcS750 initial programing charge on the T.C. Specialties <br />Company billing since this was a renewal. The Finance Director stated that the $750 charge was for the <br />original contract and should be deleted on the renewal. <br /> <br />Commissioner Cook also asked for clarification on the Stenstrom invoice - page 5, regarding WHH <br />Enterprises for $990. The City Manager will respond to the Commission in writing. <br /> <br />MOTION: <br /> <br />Moved by Vice Mayor/Commissioner Al Clark that Special Invoice and <br />Minor Contracts Report be approved as corrected. The motion was <br />seconded by Commissioner Susan Doerner and carried unanimously by <br />voice vote. <br /> <br /> 2. First Reading of Ordinance 03-1090 <br />Referendum Election and Ballot Lan~,ua~e Concerning Electric Franchise Issue <br /> <br />.MOTION: <br /> <br />Moved by Vice Mayor/Commissioner Al Clark that Ordinance 03-1090, <br />Referendum Election and Ballot Language re Electric Franchise Issue, be <br />read by title only. The motion was seconded by Commissioner Linda Hart <br />and carried unanimously by voice vote. <br /> <br />The City Clerk read Ordinance 03-1090 as follows: <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, PROVIDING <br />FOR A REFERENDUM ELECTION AND BALLOT LANGUAGE INCLUDING A <br />NON-BINDING REFERENDUM RELATING TO AWARDING A THIRTY (30) <br />YEAR FRANCHISE TO PROGRESS ENERGY FLORIDA, INC., OR THE <br />POTENTIAL ACQUISITION OF THE ELECTRIC DISTRIBUTION SYSTEM <br />OWNED BY PROGRESS ENERGY FLORIDA, INC, WITHIN THE <br />CORPORATE LIMITS OF THE CITY OF CASSELBERRY; PROVIDING FOR <br />THE CONDUCT OF THE ELECTION; PROVIDING FOR CITY CLERK <br />RESPONSIBILITIES AND COORDINATION WITH THE SEMINOLE COUNTY <br />SUPERVISOR OF ELECTIONS; PROVIDING FOR NOTICE AND THE <br />MAYOR'S PROCLAMATION OF THE NOVEMBER 4, 2003 ELECTION; <br />PROVIDING FOR SEVERABILITY, PROVIDING FOR REPEAL OF PRIOR <br />INCONSISTENT ORDINANCES; AND PROVIDING FOR AN EFFECTIVE <br />DATE. <br /> <br />Staff Presentation: The City Attorney stated that Ordinance 03-1090 was presented as a straw ballot and <br />not subject to the legal requirements ora binding referendum. The language is subject to the pleasure of <br />the Commission. <br /> <br /> <br />
