Tracts have been provided for internal <br />roads, common areas, conservation areas, lift station, drainage and retention and dedication of <br />portions of Lake Ann Lane to the public, The City Staff and the City Attorney have reviewed and <br />approved the final plat. The Planning and Zoning Commission recommended approval of the final <br />plat at their meeting of April 23, 2003. <br /> <br />· Staff Recommendation - Approve SP 03-04 - Vistas of Lake Howell based upon the following: <br /> <br />a) <br /> <br />The applicant, per F.S. Chapter 177, is responsible for the City Surveyor's fees prior to the <br />recording of the plat, payable to the City. <br /> <br />h) <br /> <br />The applicant is responsible for recording fees of the documents, payable to Seminole <br />County. <br /> <br />c) <br /> <br />A hold harmless document is required by the Developer for construction and use of model <br />homes and/or office use within the subdivision. <br /> <br />MOTION: <br /> <br />Moved by Vice Mayor/Commissioner Al Clark that SP 03-04, Vistas at Lake <br />Howell, be approved as presented. The motion was seconded by Commissioner <br />Susan Doerner and carried unanimously by voice vote. <br /> <br />3. 4:. Resolution 03-1420 - Settlement Agreement with Progress Energy, Florida <br /> <br />MOTION: <br /> <br />Moved by Vice Mayor/Commissioner Al Clark that Resolution 03-1420, <br />Settlement Agreement with Progress Energy, be read by title only. The motion <br />was seconded by Commissioner Susan Doerner and carried unanimously by <br />voice vote. <br /> <br />The City Clerk read Resolution 03-1420 by title as follows: <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY,FLORIDA, AUTHORIZING <br />THE EXECUTION OF A SETTLEMENT AGREEMENT BETWEEN FLORIDA <br />POWER CORPORATION, d/b/a PROGRESS ENERGY FLORIDA, INC. AND THE <br />CITY OF CASSELBERRY; PROVIDING FOR CONFLICTS, SEVERABILITY, <br />AND EFFECTIVE DATE." <br /> <br />StaffPresentation - This item was continued from the June 9, 2003 City Commission Meeting. The <br />City Attorney stated that Progress Energy has submitted a new Settlement Agreement which <br />includes the revisions made by the City Commission at the last meeting. Progress Energy has <br />committedtopayingtheCity$l Million dollars for all projects over a two-year period. Also, the <br />City had requested that a study, to be done in five-year intervals, regarding reliability be made <br />public; Progress Energy agreed that except to the extent that the improvements requested by the City <br />are deemed by them to violate Progress Energy's obligation against giving an undue preference to <br /> <br /> <br />
