City Commission Meeting May 12, 2003 Page 14 MOTION: Moved by Vice Mayor/Commissioner Al Clark that Resolution 03- 1420 be continued to June 9, 2003. The motion was seconded by Commissioner Susan Doerner and carried 4 - 1 on roll call vote. Mayor Bruce Pronovost dissenting. A Verbatim Transcript of Item #8 is available for review in the City Clerk's Office. 9. Resolution 03-1421 Interlocal Agreement between Apopka, Casselberry. Longwood and Winter Park MOTION: Moved by Vice Mayor/Commissioner Al Clark that Resolution 03- 1421, Interlocal Agreement between Apopka, Casselberry, Longwood and Winter Park, be read by title only. The motion was seconded by Commissioner Susan Doerner and carried unanimously by voice vote. The City Clerk read resolution 03-1421 by title only as follows: "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE ADOPTION OF AN INTERLOCAL AGREEMENT BETWEEN THE CITIES OF APOPKA, CASSELBERRY, LONGWOOD, AND WINTER PARK WHICH WOULD ALLOW THEM TO WORK TOGETHER TO RESOLVE ISSUES DEALING WITH AN ELECTRIC FRANCHISE AGREEMENT." Commissioner Clark suggested a severance clause be included in the Agreement should the City come to agreement with Progress Energy. The City Attorney stated that severance was covered in Section 3, "Termination by any Party" of the Agreement. Commissioner Cook questioned the timing of the resolution. The Agreement would have been more appropriate at the beginning of negotiations before the City had expended a great deal of money on legal fees. The other cities party to the Agreement would be benefitting from the fees expended by the City. MOTION: Moved by Vice Mayor/Commissioner Al Clark that Resolution 03- 1421, Interlocal Agreement between Apopka, Casselberry, Longwood and Winter Park, be approved as presented. The motion was seconded by Commissioner Susan Doerner and carried 4 - 1 on roll call vote. Commissioner Kathy Cook dissenting.
