The motion was seconded by <br />Commissioner Susan Doerner and carried 4 - 1 on roll call vote. <br />Mayor Bruce Pronovost dissenting. <br /> <br />A Verbatim Transcript of Item #8 is available for review in the City Clerk's Office. <br /> <br /> 9. Resolution 03-1421 <br />Interlocal Agreement between Apopka, Casselberry. Longwood and Winter Park <br /> <br />MOTION: <br /> <br />Moved by Vice Mayor/Commissioner Al Clark that Resolution 03- <br />1421, Interlocal Agreement between Apopka, Casselberry, Longwood <br />and Winter Park, be read by title only. The motion was seconded by <br />Commissioner Susan Doerner and carried unanimously by voice vote. <br /> <br />The City Clerk read resolution 03-1421 by title only as follows: <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AUTHORIZING THE ADOPTION OF AN INTERLOCAL AGREEMENT <br />BETWEEN THE CITIES OF APOPKA, CASSELBERRY, LONGWOOD, <br />AND WINTER PARK WHICH WOULD ALLOW THEM TO WORK <br />TOGETHER TO RESOLVE ISSUES DEALING WITH AN ELECTRIC <br />FRANCHISE AGREEMENT." <br /> <br />Commissioner Clark suggested a severance clause be included in the Agreement should the City <br />come to agreement with Progress Energy. The City Attorney stated that severance was covered <br />in Section 3, "Termination by any Party" of the Agreement. <br /> <br />Commissioner Cook questioned the timing of the resolution. The Agreement would have been <br />more appropriate at the beginning of negotiations before the City had expended a great deal of <br />money on legal fees. The other cities party to the Agreement would be benefitting from the fees <br />expended by the City. <br /> <br />MOTION: <br /> <br />Moved by Vice Mayor/Commissioner Al Clark that Resolution 03- <br />1421, Interlocal Agreement between Apopka, Casselberry, Longwood <br />and Winter Park, be approved as presented. The motion was <br />seconded by Commissioner Susan Doerner and carried 4 - 1 on roll <br />call vote. Commissioner Kathy Cook dissenting. <br /> <br /> <br />
