The Pla~'mg and Zoning Commission granted a conditional use which allowed the <br />excess elevation in building height to 48 feet. <br /> <br />After the Planing and Zoning Commission had reviewed site plan, the applicant's architect <br />realized there was another small issue regarding the height of the building that was inadvertently <br />overlooked. The final decorative material on the edge of the building in the fi'ont of the Rotunda <br />exceeds the 35' building height criteria. The applicant is seeking an amendment to the conditional <br />use approval already received by the Planning and Zoning Commission to allow for a 36'8" height <br />on the front of the Rotunda. The requested amendment would not significantly impact the height <br />conditions normally imposed on the building. <br /> <br />The Planning and Zoning Commission reviewed SPR 03-01 at their meeting of February 12, 2003 <br />and unanimously recommended approval to the City Commission with the following conditions. <br /> <br />a. Section3-13.3(B): Reduction ofthe required street fromage landscape strip width from <br /> 20 feet to 10 feet adjacent to SR 436 and Howell Branch Road. <br /> <br />b. Section 3-13.5: Reduction of the required perimeter landscape strip width from 10 feet <br /> to 5 feet adjacent to the Eckerd's site. <br /> <br />c. Section 3-15,6(C): Eliminate the requirement for a loading dock at the LA Fitness <br /> building. <br /> <br />The applicant shall submit a photometric plan and fixture cut sheets that meet the City's <br />ULDR criteria prior to issuance of the City's site construction permit. A light loss factor <br />shall not be used to determine the footcandle levels. <br /> <br />The owner shall upsize 225 trees or make a contribution to the City Tree Bank in the <br />amount of $18,000 or a combination to offset the 90-tree deficit from the landscape <br />requirement. <br /> <br />A landscape maintenance agreement must be executed prior to issuance of the building <br />permit. <br /> <br />Per Section 3-15.6, the 139 parking spaces are allowed to be reduced to a 9' X 18' <br />dimension. <br /> <br />A separate sign permit must be obtained prior to construction of fagade or monument <br />signs. <br /> <br /> <br />
