from commencement of construction date to Substantial Completion from the issuance of the <br />written Notice to Proceed, plus thirty 30 calendar days after receipt of SJRWMD clearance to <br />Final Completion. Contractor shall pay the Owners as liquidated damages the amount of ONE <br />THOUSAND FIVE HUNDRED DOLLARS AND NO/100 ($1,500.00) for each calendar day <br />that expires after the Contract Time specified above, including any adjustments thereof approved <br />by proper Change Order until the Work is finally complete. This amount represents an estimate <br />of Owner's damages for loss of use and administrative costs associated with delay. <br />5. AUTHORITY AND REPONSIBILITY OF THE OWNER <br />All Work shall be done under the general supervision of the Owner. The Owner shall decide <br />any and all questions which may arise as to the quality and acceptability of the materials <br />furnished , work performed, rate of progress of work, interpretation of Specifications, and all <br />questions as to the acceptable fulfillment of the Agreement on the part of the Contractor. These <br />provisions shall not release the Contractor from any Contractor responsibility contained herein. <br />6. CONTRACT DOCUMENTS <br />The Agreement comprises the Contract Document listed herein. In the event that any <br />provision of one Contract Document conflicts with the provisions of another Contract Document, <br />the provision in that Contract Document first listed below shall govern, except as otherwise <br />specifically stated: <br />a. Agreement <br />b. Change Orders <br />C. Addenda to Contract Documents, Nos. ; <br />d. Bid; <br />e. Instructions to Bidders <br />f. Detailed Specification Requirements <br />g. Drawings <br />h. General Conditions <br />i. Advertisement; <br />j. Performance and Payment Bond <br />k. Proposal Guaranty <br />7. IN WITNESS WHEREOF <br />The Parties hereto have caused this instrument to be executed in three (3) original counterparts <br />the day and year first above written. <br />
