The conditional use shall expire if the use is discontinued for more than 90 days. <br />8. All of'the above conditions shall be fully and faithfully executed, or the conditional use <br />.shall become null and void. <br />MOTION: Mr. Minnis moved that the Planning and Zoning Commission, acting as the <br />City's Local Planning Agency, approve Case number COU 24-01, based on the staff report <br />and the testimony and evidence presented, that the request meets the applicable provisions <br />of the ULDR and is consistent with the City's Comprehensive Plan as per the written <br />findings in the staff report. Mr. Curran seconded the motion. The motion passed <br />unanimously by voice vote. <br />7. Site Plan Applications <br />A. SPR 24-09: Solar Canopy for JVD Construction <br />Staff Presentation: Antonia DeJesus, Chief Planner, presented the agenda item and provided an <br />overview of the site plan request. The applicant, JVD Construction, Inc., is requesting site plan <br />approval to erect a solar canopy to store recreational vehicles on the property at 350 Anchor Road. <br />The approximately 17 -acre property has a Future Land Use Map (FLUM) designation of Industrial <br />(IND) and is zoned I (Industrial). <br />The proposed improvements include a canopy for recreational vehicles as well as associated <br />parking areas and access. Per ULDR Section 4-18.2, the addition of more than 500 sq. ft. of <br />impervious area requires a major site plan approval. Regarding evaluative criteria, Ms. DeJesus <br />explained that the property's FLUM designation and zoning district are considered consistent with <br />each other. She also noted that the I zoning district is intended to accommodate a wide range of <br />light industrial uses and is thus suitable for this proposal. <br />The proposed canopy and parking area are sized approximately 55'x221', which meets the <br />appliable setback, size, height and dimension requirements provided in ULDR Section 2-5.4. <br />Additionally, the property is fenced and the proposed location for the canopy is on the side of the <br />building. The canopy will be illuminated for safety, but the modified photometric plan still meets <br />the Lighting and Photometric criteria provided in ULDR Section 3-10.2.6. Stormwater facilities <br />on the site will also not need to be upgraded or modified to accommodate the proposed <br />improvement, per comments from Jane Dai, City Engineer. <br />Regarding landscaping, Ms. DeJesus noted that landscape buffer requirements were applied to the <br />eastern property lines. No trees are being removed for the project and the applicant will be <br />installing a combination of canopy trees and shrubs to provide screening from the right-of-way. <br />Lastly, no new signage is proposed and the plan exceeds minimum parking requirements, with a <br />total of 197 spaces. <br />Staff recommends that Planning and Zoning Commission/Local Planning Agency, recommend <br />approval of case number SPR 24-09, based on the staff report and the testimony and evidence <br />
