5. DISCLOSURE OF EX PARTE COMMUNICATIONS <br />No disclosures of ex -parte communications were made. <br />6. CONDITIONAL USE APPLICATIONS <br />A. COU 24-01: Cheddar's Scratch Kitchen Conditional Use Request for Beer Wine and Liquor <br />Staff Presentation: Matt Linder, Planner I, presented the agenda item and provided an overview <br />of the conditional use request. The applicant, Cheddar's Scratch Kitchen, is requesting approval <br />for beer, wine and liquor sales (4COP) for on-site consumption at a new restaurant planned for a <br />vacant property just north of the old police department, adjacent to Lake Concord. <br />Mr. Linder noted that the sale of Alcoholic Beverages for On -Site Consumption requires <br />conditional use approval from the Planning and Zoning Commission, as provided in Unified Land <br />Development Regulations (ULDR) Table 2-5.3. Regarding land use compatibility, the site is <br />located along U.S. 17-92 and has a Future Land Use Map (FLUM) designation of Major <br />Thoroughfare Mixed -Use (MTMU), making it ideal for a restaurant or other commercial uses. To <br />the north is a Home Depot and Publix shopping plaza consisting of a variety of consumer services <br />and retail stores. To the east is Lake Concord, to the west is U.S. Highway 17-92, and to the south <br />is City property. <br />Alcohol sales will be incidental to the site's primary use as a restaurant and as such, are not <br />anticipated to adversely impact the surrounding areas. As for the size and adequate site <br />specifications, the staff is not concerned about this criterion given that a Planned Unit <br />Development (PUD) agreement has been executed for this site providing specific development <br />standards and design criteria. Mr. Linder then went on to note that, as of today's date, the location <br />of the property satisfies the applicable distance separation requirements provided in ULDR Section <br />10-7. <br />Staff recommends that case number COU 24-01 be approved with staff's conditions, based upon <br />the staff report and the testimony and evidence presented, that the request meets the applicable <br />provisions of the Unified Land Development Regulations and is consistent with the <br />Comprehensive Plan as per the written findings contained within the staff report. <br />The conditions of approval are as follows: <br />1. The conditional use shall be limited to the subject parcels (Parcel Numbers: 08-21-30- <br />5BL-OB00-0010 and 08-21-30-5BL-IF00-0040). <br />2. All sales and consumption of alcoholic beverages, except for approved package sales, <br />shall be on-site and indoors or confined to outdoor seating areas as part of an approved <br />site plan per ULDR Article XVIII, Site Plan Review. <br />3. Sale of alcoholic beverages is prohibited when,food service is unavailable. <br />4. The hours of on-site alcohol consumption and sales shall comply with the hours outlined <br />in City Code Section 10-2. <br />
