Motion carried unanimously by <br />voice vote 5-0. <br />10. FIRST READING OF ORDINANCES <br />No items were presented for consideration on this agenda. <br />11. PUBLIC HEARINGS <br />A. Public Hearing: Second Reading of Ordinance 24-1617 — Repealing in Its Entirety <br />Article III, "Peddlers, Solicitors, Begging and Panhandling" of Chapter 26 <br />"Businesses" of the City Code of Ordinances <br />The City Clerk read Ordinance 24-1617 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA; REPEALING IN ITS <br />ENTIRETY ARTICLE III, "PEDDLERS, SOLICITORS, BEGGING AND PANHANDLING" OF <br />CHAPTER 26, "BUSINESSES" OF THE CITY CODE OF ORDINANCES; PROVIDING FOR <br />CODIFICATION; CONFLICTS, SEVERABILITY; AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 24-1617 <br />was advertised in the Orlando Sentinel on Friday, January 17, 2025. <br />Business Impact Statement: A Business Impact Statement was provided for this ordinance in accordance <br />with Section l 66.041(4), Florida Statutes. <br />Staff Presentation: As a result of recent related state and federal case law which has found against similar <br />ordinances, Article III "Peddlers, Solicitors, Begging and Panhandling" of Chapter 26, `Businesses" of the <br />City Code of Ordinances may be susceptible to constitutional challenge and lead to civil damages. <br />Therefore, staff finds that repeal of Article III "Peddlers, Solicitors, Begging and Panhandling" of Chapter <br />26, `Businesses" is in the best interests of the public health, safety , and welfare of the citizens of the City. <br />Ordinance 24-1617 was approved by the City Commission on first reading on December 16, 2024 and there <br />have been no changes to the ordinance since first reading. City Manager Randy Newlon advised that both <br />the City Attorney and Police Chief Larry Krantz were available for any questions related to the ordinance. <br />Budget Impact: There is no budget impact to the City Budget. <br />Recommendation: The City Manager and the Police Chief recommended adoption of Ordinance 24-1617 <br />on second and final reading. <br />
