Code Enforcement Hearing <br />Minutes, November 21, 2024 <br />Page 5 <br />each day of non-compliance thereafter. The City requested a subsequent hearing date of January 16, 2025, <br />to determine compliance. There were residents present to speak about this case. <br />Discussion: Trisha Holt, 1406 Tierra Circle, Winter Park, FL described that the photos are of a 50 ft buffer, <br />trees were cut down and a large debris pile was left. Due to the removal of the trees the buffer was removed, <br />they can hear traffic from SR 436, they see the building and the lights from the Hollar dealership shine into <br />their homes. Ms. Holt stated she think the quality of life has been taken away. Ms., Holt continued. <br />Virginia Urichko 1392 Tierra Circle, Winter Park, FL advised that one of the debris piles is behind her wall <br />and now feels unsafe, due to someone being able to walk up on the pile. Ms. Urichko also stated that a tree <br />looks to have been struck by lightning, she contacted the property manager, but nothing has been done. <br />Special Magistrate Ruling: A ruling was made by the Special Magistrate that case CE -24-004076, located <br />at 2025 SR 436 and was found in violation of City Code 3-10.3.C.3., 3-13.8.A, and 4-18.2.0 and if there is <br />no compliance a $150.00, $150.00, and $250.00 per day fine will be imposed. The Respondent was given <br />until December 23, 2024, to achieve compliance. A subsequent hearing will be held on January 16, 2025, <br />to determine if compliance has been achieved. <br />L. CE -24-003767: 221 Colony Drive <br />Violation — City Code 3-10.9.2.a.2 Recreation Equipment Screening Requirements <br />City Code 3-10.3.b.I Fence in Disrepair <br />Staff Presentation: Marie Plaza, Code Compliance Officer gave testimony for case CE -24-003767, located <br />at 221 Colony Drive. The property was reinspected and found to remain in violation on November 18, 2024. <br />The City requested a correction date of December 23, 2024. If there is no compliance by December 23, <br />2024, then a fine of $75.00 and $75.00 per day should then be imposed for each day of non-compliance <br />thereafter. The City requested a subsequent hearing date of January 16, 2025, to determine compliance. <br />There was no one present to speak about this case. <br />Discussion: There was no further discussion. <br />Special Magistrate Ruling: A ruling was made by the Special Magistrate that case CE -24-003767, located <br />at 221 Colony Drive and was found in violation of City Code 3-10.9.2.a.2 and 3-10.3.b. Land if there is no <br />compliance a $75.00 and $75.00 per day fine will be imposed. The Respondent was given until December <br />23, 2024, to achieve compliance. A subsequent hearing will be held on January 16, 2025, to determine if <br />compliance has been achieved. <br />M. CE -24-001054: 806 The Spur <br />Violation — City Code 1-4.3.a No Building permit. <br />Staff Presentation: Tyler Hall, Code Compliance Officer gave testimony for case CE -24-001054, located <br />at 806 The Spur. The property was reinspected and found to remain in violation on November 18, 2024. <br />The City requested a correction date of December 23, 2024. If there is no compliance by December 23, <br />2024, then a fine of $100.00 per day should then be imposed for each day of non-compliance thereafter. <br />The City requested a subsequent hearing date of January 16, 2025, to determine compliance. There was no <br />one present to speak about this case. <br />
