<br />$75.00, $50.00 and $75.00 per day fine would be imposed. The Respondent was given until November 20,
<br />2024, to achieve compliance. A subsequent hearing well be held on November 21, 2024, to determine if
<br />compliance has been achieved.
<br />B. CE -24.001697: 270 Fern Street
<br />Violation — City Code 3-10.3.c.4 Obstruction in public Right -of -Way - Plant material/debris

<br />City Code 3-10.3.b.1 Fence in disrepair
<br />City Code 3-10.3.b.2 Deteriorated or damaged fence
<br />Staff Presentation: Tyler Hall, Code Compliance Officer gave testimony for case CE -24-001697, located
<br />at 270 Fern Street. The property was reinspected and found to remain in violation on September 16, 2024.
<br />The City requested a correction date of October 17, 2024. If there is no compliance by October 17, 2024,
<br />then the requested fines should then be imposed for each day of non-compliance thereafter. The City
<br />requested a subsequent hearing date of October 17, 2024, to determine compliance. There was a
<br />representative present to speak about this case.
<br />Discussion: Andrew Spivey, 270 Fern Street gave testimony. Mr. Spivey advised that he was not aware of
<br />the violations, but stated the fence was broken in the storm. Mr. Spivey understands it's overgrown but is
<br />not in town a whole lot. Mr. Spivey stated is the tenant of the property.
<br />Special Magistrate Ruling: A ruling was made by the Special Magistrate that case CE -24-001697, located
<br />at 270 Fern Street and was found in violation of City Code 3-10.3.c.4, City Code 3-10.3.c.1, City Code 3-
<br />10.3.b.1, City Code 3-10.3.b.2 and if there is no compliance a $50.00 per day, per violation fine should be
<br />imposed. The Respondent was given until October 17, 2024, to achieve compliance. A subsequent hearing
<br />well be held on October 17, 2024, to determine if compliance has been achieved.
<br />C. CE -24-001941: 204 Brighton Way
<br />Violation — City Code 3-10.9.d.2.a.2 Recreation equipment screening requirements
<br />Staff Presentation: Jacob Salas, Code Compliance Officer gave testimony for case CE -24-001941, located
<br />at 204 Brighton Way. The property was reinspected and found to remain in violation on September 16,
<br />2024. The City requested a correction date of October 03, 2024. If there is no compliance by October 03,
<br />2024, then a fine of $50.00 per day should then be imposed for each day of non-compliance thereafter. The
<br />City requested a subsequent hearing date of October 17, 2024, to determine compliance. There was a
<br />representative present to speak about this case.
<br />Discussion: Annelise Pico -Barrios, 204 Brighton Way gave testimony and advised that they have been in
<br />communication and the material is the typical PVC panel. Ms. Pico -Barrios advised that she had been
<br />unemployed, so it has taken a little bit more time.
<br />Alexander Pico, stated they had had several code officers over the years, tell them different things. Mr. Pico
<br />stated he did not think they needed a permit, because the fencing was not permanent.
