CE -24-001697: 270 Fern Street <br />Violation — City Code 3-10.3.c.4 Obstruction in public Right -of -Way - Plant material/debris <br />City Code 3-10.3.c.1: Overgrowth, weeds, trash and debris <br />City Code 3-10.3.b.1 Fence in disrepair <br />City Code 3-10.3.b.2 Deteriorated or damaged fence <br />Staff Presentation: Micelania Acevedo, Code Compliance Supervisor advised that subsequent case CE - <br />24 -001697, 270 Fern Street was in compliance. No further action was taken. <br />B. CE -24.001941: 204 Brighton Way <br />Violation — City Code 3-10.9.d.2.a.2 Recreation equipment screening requirements <br />Staff Presentation: Micelania Acevedo, Code Compliance Supervisor advised that subsequent case CE - <br />24 -001941, 204 Brighton Way was in compliance. No further action was taken. <br />NEW CASE <br />A. CE -24.000259: 40 N. Sunset Drive <br />Violation — City Code 2-7.9.a.7.a.2 Temporary Structures -Permit Required <br />Staff Presentation: Tyler Hall, Code Compliance Officer gave testimony for case CE -24-000259, located <br />at 40 N. Sunset Drive. The property was reinspected and found to remain in violation on October 14, 2024. <br />The City requested a correction date of October 31, 2024. If there is no compliance by October 31, 2024, <br />then a fine of $75.00 per day should then be imposed for each day of non-compliance thereafter. The City <br />requested a subsequent hearing date of November 21, 2024, to determine compliance. There was a <br />representative present to speak about this case. <br />Special Magistrate Ruling: A ruling was made by the Special Magistrate that case CE -24-000259, located <br />at 40 N. Sunset Drive and was found in violation of City Code 2-7.9.a.7.a.2 and if there is no compliance a <br />$75.00 per day fine will be imposed. The Respondent was given until October 31, 2024, to achieve <br />compliance. A subsequent hearing well be held on November 21, 2024, to determine if compliance has <br />been achieved. <br />Discussion: The property owner was sworn in by the Special Magistrate. Anthony Taranto. 40 N. Sunset <br />Drive asked for a 2 -4 -week extension of time. Mr. Hall advised that the ruling was for 2 weeks. <br />B. CE -24-000324: 1084 Timberlane Trail <br />Violation — City Code 1-4.3.a No Building Permit <br />Staff Presentation: Tyler Hall, Code Compliance Officer gave testimony for case CE -24-000324, located <br />at 1084 Timberlane Trail. The property was reinspected and found to remain in violation on October 14, <br />2024. The City requested a correction date of November 18, 2024. If there is no compliance by November <br />18, 2024, then a fine of $150.00 per day should then be imposed for each day of non-compliance thereafter. <br />
