AGREEMENT FOR Y <br />LAW ENFORCEMENT AGENCY USE OF <br />SEMINOLE STATE COLLEGE PUBLIC SAFETY TRAINING COMPLEX <br />THE GENEVA CENTER CONTRACT YEAR 2024-2025 <br />Law Enforcement Agency: <br />Contracting Entity: <br />Entity Address: <br />City, State, Zip: <br />Contact Name: <br />Contact Telephone Number: <br />Contact Email Address: <br />Casselberry Police Department <br />City of Casselberry <br />95 Triplet Lake Drive <br />Casselberry, FL 32707 <br />Brandy Ramirez <br />407-262-7616 <br />bramirez@casselberry.org <br />In consideration of the mutual promises and agreements described herein, The District Board of <br />Trustees of Seminole State College ("College") hereby agrees to the use of its Public Safety <br />Training Complex located at 2450 Gun Range Road, Geneva, Florida, 32732, by the Law <br />Enforcement Agency named above ("User") upon the following terms and conditions: <br />1. College shall: <br />a. Make available to User the Public Safety Training Complex facilities indicated in <br />section 2 at such times as provided for User in the reservation calendar and furnish <br />light, heat, and water by means of the appliances installed for ordinary purposes, <br />but for no other purposes. Interruptions, delays, or closure of the Geneva facilities <br />due fire, hurricane, earthquake, explosion, wars, sabotage, accident, flood, acts of <br />God, strikes, or other labor disputes, riot or civil commotions, or by reason of any <br />other matter or condition beyond the control of either party, and which cannot be <br />overcome by reasonable diligence and without unusual expense ("Force Majeure") <br />shall excuse the College's performance under this agreement. In the event that a <br />force majeure event occurs, FDLE/CJSTC approved law enforcement training <br />schools shall be given priority in rescheduling time at the facilities. <br />b. Be fully responsible for its own acts of negligence and the acts of negligence of its <br />respective officers, agents, and employees acting within the scope of their agency <br />or employment and agrees to be responsible for any damages resulting from said <br />negligence, subject to the limitations and defenses provided by Section 768.28, <br />Florida Statutes. Nothing herein is intended to serve as a waiver of sovereign <br />immunity or the limitations and defenses of Section 768.28, Florida Statutes by the <br />College. Nothing herein shall be construed as consent by the College to be sued by <br />third parties in a manner arising out of this Agreement. <br />c. Provide User and other agencies an opportunity to schedule time at the facilities in <br />July of each year for the following contract year (October to September). Activities <br />of the College shall have first priority in use of the Public Safety Training Complex. <br />The College may, at its sole discretion, suspend any use of the facilities by User <br />when, in its opinion, the purpose or purposes for which the facilities are being used <br />or intended to be used, is in a manner that is unsafe and /or prevents or impedes <br />the use of the facilities by other agencies. This Agreement may be terminated as <br />provided herein if User's use is suspended on more than one occasion. <br />
