Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />October 11, 2023 <br />Page 6 <br />Act, which amends Chapter 166.04151 of Florida Statutes and took effect on effect July 1, 2023. <br />The amendment intends to streamline and incentivize affordable housing developments by <br />preempting certain use, density, and height regulations for such qualifying developments in <br />commercial, industrial, or mixed-use zoning districts. If a municipality has designated less than <br />20% of the land area within its jurisdiction for commercial or industrial use, any proposed <br />qualifying affordable housing development must be mixed-use, as used in Fla. Stat. <br />166.04151(7)(f). <br />The first change includes amending ULDR Article V to add Section 2-5.5, Affordable Housing <br />under the Live Local Act, including: Applicability of regulations, including zoning districts and <br />affordability commitment, development standards per Fla. Stat. 166.04151, eligibility for <br />administrative site plan review and approval. The second change includes amending ULDR Article <br />X to add Section 3-10.14, Multifamily Development Design Standards, including: Conformance <br />with off-street parking, lighting, and landscape requirements, minimum living areas, setbacks, <br />other standards, and architectural controls. The third change includes amending ULDR Article XII <br />to modify Section 5-21.2, Definition of Terms, to provide definitions that are consistent with Fla. <br />Stat. 166.04151. <br />Staff recommends that the Planning and Zoning Commission provide a favorable recommendation <br />to the City Commission for LPA 23-02, which: adds Section 2-5.5, Affordable Housing under the <br />Live Local Act; adds Section 3-10.14, Multifamily Development Design Standards; and Modifies <br />Section 5-21.2, Definition of Terms, of the City's ULDR, and is consistent with the City's <br />Comprehensive Plan. <br />Discussion: A lengthy discussion ensued on the intent of the proposed ordinance amendment. <br />Christopher Schmidt, Community Development Director, addressed the Planning and Zoning <br />Commission. <br />Audience Participation: No one came forward to address this item. <br />MOTION: Mr. Curran moved to recommend a favorable recommendation to the <br />City Commission for LPA 23-02, Ordinance Amendment which adds <br />Section 2-5.5, affordable housing under the Live Local Act; adds Section <br />3-10.14, Multifamily development design standards; and modifies <br />Section 5-21.2 Definition of Terms of the City's ULDR and is consistent <br />with the City's Comprehensive Plan. Motion was seconded by Mr. <br />Bryan. The motion passed unanimously by voice vote. <br />9. Other Business <br />Carolyn Stanley, a new member of the commission, introduced herself. <br />10. Adjournment <br />Chairman Bakalla made a motion to adjourn the meeting at 7:37 p.m. <br />
