Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />November 8, 2023 <br />Page 3 <br />Audience Participation: No one came forward to address this item. <br />MOTION: Mr. Bryan moved to approve CU 23-15, based upon the staff report and the <br />testimony and evidence presented, that the request meets the applicable <br />provisions of the ULDR as per the written findings contained within the staff <br />report and staffs nine conditions. Motion was seconded by Vice -Chairman <br />Curran. The motion passed unanimously by voice vote, 5-0. <br />7. Site Plan Applications <br />There were no site plan applications presented on this agenda. <br />8. Future Land Use Map and Zoning Map Amendments <br />There were no amendments to the City's Future Land Use Map or the Official Zoning Map <br />presented on this agenda. <br />9. Public Hearings <br />A. BA 23-02: Variance Request for at Wheel Park Phase I <br />Staff Presentation: Mr. Linder presented the agenda item and provided an overview of the <br />variance request. The request is related to the installation of light fixtures at the new park that <br />exceeds the 20 ft. maximum height limit for light fixtures provided in ULDR Section 3-10.2. <br />Specifically, the proposed poles are 60 ft., and ULDR Section 1-2.7 allows the Planning and <br />Zoning Commission to grant variances in circumstances that meet the necessary criteria. <br />Mr. Linder noted that all advertising procedures were abided by, with a legal ad being placed in <br />the Orlando Sentinel on October 24, 2023, with a letter being sent out to all property owners within <br />300 ft. of the subject property. Additionally, a physical notice of the variance request was posted <br />on the property the following day. <br />Mr. Linder explained that the specialty lighting will adequately illuminate the bicycle tracks to <br />ensure adequate visibility and overall safety during operating hours. Then, Mr. Linder analyzed <br />the variance request against the criteria outlined in ULDR Article VI, including the existence of <br />special conditions and the proposal of the minimum variance possible. Mr. Linder also noted the <br />efforts made to decrease light pollution. Mr. Linder provided the following conditions: <br />1. A building permit is required for the installation of the specialty lighting. <br />2. Any site lighting changes or additions shall not be installed without prior review and <br />approval of the City's Planning Division. <br />3. All of the above conditions shall be fully and faithfully executed, or the variance shall <br />become null and void. <br />
