Further, the subject properties are not <br />in any overlay districts. To the north of the subject properties is an assisted living facility and several <br />single-family homes while to the east are more single-family homes located in unincorporated <br />Seminole County. To the south is a townhome community, which was developed as the first phase <br />of Slovak Garden and is now known as Grayson Square. <br />The properties were annexed into the City of Casselberry via Ordinance 20-1535 in 2020. In 2021, <br />they were rezoned to PRD (Planned Residential Development) through Ordinance 21-1551 to <br />establish the Slovak Garden PUD and outline standards for the first phase of development. In 2022, <br />the applicant submitted a concept plan to modify the existing PUD agreement for the second phase <br />of development. The property is being rezoned from PRD to PRD to provide a concept plan and <br />development standards for a second phase of development and will need to adhere to the <br />requirements in ULDR Article XX. Any modifications to an existing PUD require an updated <br />concept plan. Ms. DeJesus described the proposed concept to the Commission, first noting that the <br />proposal is generally compatible with the surrounding properties and adjacent land uses. <br />Further, the Medium Density Residential (MDR) Future Land Use Map (FLUM) designation <br />allows for a maximum density of 13 dwelling units per acre. Police is serviced by City of <br />Casselberry and fire services are provided by Seminole County. Vehicular and pedestrian access <br />is provided by Howell Branch Road and Jergo Road and connections to City water and sanitary <br />sewer are available. The units are also age -restricted, so there is not a requirement for a school <br />impact analysis letter from Seminole County. The subject properties are not located in any <br />floodplain or wetlands and the proposed amendment is not anticipated to have a negative <br />environmental impact. As a new project, the development is designed to increase property values <br />in the area. Some portions of the subject property are currently vacant and as such, developing the <br />property will generate a tax increase for the City. DRC approved the concept plan in early <br />November 2023, which will govern any future development of the site. <br />Staff recommends that the Planning and Zoning Commission/Local Planning Agency recommend <br />approval of case number ZB 21-04 to the City Commission, based on the staff report and the <br />testimony and evidence presented, that the request meets the applicable provisions of the ULDR <br />and is consistent with the Comprehensive Plan as per the written findings contained in the staff <br />report. <br />Discussion: Members of the Planning and Zoning Commission first asked questions of staff for <br />case ZB 21-04 and a lengthy discussion ensued. Chairman Bakalla then asked the applicant to <br />come forward. Jose Chavez, a representative of Storybook Development Services, 5931 Brick <br />Court, Suite 168, Winter Park, Florida, came forward and briefly addressed the Commission. <br />Audience Participation: Chairman Bakalla asked if there was anyone in the audience to speak <br />about this item. No one came forward to speak about this item. <br />MOTION: Ms. Stanley moved to recommend approval of ZB 21-04 to the City <br />Commission based upon the staff report and the testimony and <br />evidence presented, that the request meets the applicable provisions of <br />the City Code of Ordinances and the Unified Land Development <br />
