The City Commission agreed as a whole that the proposed <br />amendment and change to the process for testing to be conducted by the City would be beneficial to both <br />the customers and staff, as it would provide a cost savings to the customers and more convenient process <br />for both customers and staff. <br />Budget Impact: There is no impact to the Fiscal Year 2024 City Budget. This change has been considered <br />in the proposed Fiscal Year 2025 Budget. <br />Recommendation: The City Manager and the Public Works & Utilities Director recornmended adoption <br />of Ordinance 24-1608 on second and final reading. <br />Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 24-1608. Mayor Henson opened the floor for public participation. No one <br />came forward to address Ordinance 24-1608. Mayor Henson closed the public hearing relative to <br />Ordinance 24-1608. <br />MOTION: Commissioner Busch moved to adopt Ordinance 24-1608 on second and final <br />reading, as presented. Motion was seconded by Commissioner Divita. <br />Motion carried unanimously by voice vote 4-0. <br />B. Public Hearing: Second Reading of Ordinance 24-1606 — Amending, Repealing, <br />and Replacing Various Sections of City Code Relating to Home Based Businesses <br />The City Clerk read Ordinance 24-1606 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY <br />CODE OF ORDINANCES, CHAPTER 26, BUSINESS, ARTICLE II, LOCAL BUSINESS TAX, <br />SECTION 26-45, LOCAL BUSINESS TAX SCHEDULE; AMENDING PART III, UNIFIED LAND <br />DEVELOPMENT REGULATIONS, CHAPTER II, DISTRICT AND GENERAL REGULATIONS, <br />ARTICLE VII, GENERAL REGULATIONS, SECTION 2-7.17, HOME OCCUPATIONS; AND <br />CHAPTER V, GLOSSARY, ARTICLE XXI, LANGUAGE AND DEFINITIONS, SECTION 5-21.2, <br />DEFINITION OF TERMS; ALL TO CONFORM TO FLA. STAT. 559.955; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 24-1606 <br />was advertised in the Orlando Sentinel on Friday, September 13, 2024. <br />Business Impact Statement: Ordinance 24-1606 is exempt under Florida Statutes Section 166.041(4)(c) <br />from the provision of a Business Impact Statement because it pertains to compliance with Federal and State <br />law or regulation. <br />Staff Presentation: Chief Planner Antonia DeJesus gave an overview of Ordinance 24-1606 which <br />proposes to amend, repeal, and replace various sections of the City's Code of Ordinances and Unified Land <br />Development Regulations relating to home-based businesses. Florida Statute 559.955 was recently enacted, <br />and it preempts the field of regulation of home-based businesses to a great extent. Several provisions of <br />
