CASSELBERRY CITY COMMISSION <br />Minutes of September 9, 2024 — Regular Meeting <br />Page 8 of 16 <br />ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE <br />DATE." <br />Staff Presentation: Planner I Matt Linder stated that Ordinance 24-1610 amends the Future Land Use <br />Map (FLUM) designation for one parcel located at 210 N.E. Triplet Drive (Parcel ID 09-21-30-506-0400- <br />0010) from Low Density Residential (LDR) to Medium Density Residential (MDR). The subject property <br />is approximately 2.79 acres and currently has a FLUM designation of LDR with R-9 (Low Density Single - <br />Family) zoning. The applicant has expressed an interest in developing the subject property with multifamily <br />units similar to the surrounding multifamily developments, and staff has advised them of the required land <br />entitlement change. The applicant has also applied for a corresponding zoning map amendment to RMF - <br />13 (Medium Density Multifamily), which is consistent with the requested MDR Future Land Use Map <br />designation. The Planning and Zoning Commission, acting as the City's Local Planning Agency (LPA) <br />voted 6-1 at its meeting on August 14, 2024 to recommend approval of this ordinance to the City <br />Commission. The request to amend the City's Future Land Use Map designation from Low Density <br />Residential (LDR) to Medium Density Residential (MDR) is consistent with the City's Comprehensive <br />Plan and MDR FLUM designation and compatible with the surrounding mix of land uses and zoning <br />districts. The Seminole County School Board has verified that the maximum density for the MDR will be <br />able to be accommodated without exceeding the adopted Levels of Service (LOS) for the currently zoned <br />schools, and capacity for City water and sanitary sewer services for the subject property will be verified <br />prior to second reading. In response to concerns brought up by Commissioner Albritton related to sewer <br />and water connections, environmental issues and whether any studies had been done, zoning, and traffic <br />and safety issues, Mr. Linder advised that if the property is developed as a multifamily project the City <br />would require connection to City sewer and water and modeling was currently underway and the results <br />would be available prior to second reading. Concerns about environmental studies, traffic safety and <br />lighting issues would be addressed through the development and site planning process and would be looked <br />at and analyzed closely. A request for a zoning amendment to RMF -13, the corresponding zoning district <br />for MDR, will also be coming forward, and if approved, would make the property subject to the <br />performance criteria set forth for that designation in the Unified Land Development Regulations. <br />Budget Impact: There is no impact on the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 24-1610 on first reading. <br />Audience Participation: The following individuals came forward to address Ordinance 24-1610. <br />1. Erik Andersen, 287 Hill Street, spoke in opposition to Ordinance 24-1610. <br />2. Jessica Ganson, 224 Hill Street, spoke in opposition to Ordinance 24-1610. <br />3. David Spindler, 212 Hill Street, spoke in opposition to Ordinance 24-1610. <br />No one else came forward to address Ordinance 24-1610. <br />MOTION: Vice Mayor Aramendia moved to approve Ordinance 24-1610 on first <br />reading, as presented. Motion was seconded by Commissioner Busch. Motion <br />carried by voice vote 4-1, Commissioner Albritton dissenting. <br />
