Motion <br />was seconded by Commissioner Miller. Motion carried <br />unanimously by voice vote 5 - 0. <br />B. Second Reading of Ordinance 08-1251 - "Glitch" Ordinance Amending the Unified <br />Land_ Development Regulations to Clarify Various Sections of the City Code (ZB 08- <br />06 <br />The City Clerk read Ordinance 08-1251 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING <br />SELECTED SECTIONS OF THE CITY CODE OF ORDINANCES, PART III, UNIFIED <br />LAND DEVELOPMENT REGULATIONS, AMENDING SECTION 2-5.3, LAND USE <br />BY DISTRICTS, OF ARTICLE V, ZONING DISTRICT REGULATIONS, OF CHAPTER <br />II, DISTRICT AND GENERAL REGULATIONS, TO PROVIDE ADDITIONAL <br />PROHIBITED USES; AMENDING ARTICLE VII, SECTION 2-7.10, FENCES AND <br />WALLS, TO CLARIFY VARIOUS CRITERIA FOR FENCES AND WALLS, <br />AMENDING ARTICLE X, SECTION 3-10.9, PARKING IN RESIDENTIAL DISTRICTS <br />TO CLARIFY PARKING OF VEHICLES WITH RACKS AND ATTACHMENTS; <br />PROVIDING FOR SEVERABILITY, CODIFICATION, CONFLICTS, AND EFFECTIVE <br />DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 08-1251 was published in <br />the Orlando Sentinel on October 30, 2008. <br />Staff Presentation: Ms. Sandra Smith, Chief Planner stated Ordinance 08-1251 provides clarification to <br />portions of adopted City Code, Part III, Unified Land Development Regulations (ULDR) regarding <br />prohibited uses within Section 2-5.3, Land Use by District, criteria for fences and walls, and the proper <br />location for parking vehicles with attachments and accessories in residential districts. The proposed edits <br />are: <br />Section 2-5.3, Land Use by District to add prohibited uses provided within the <br />Comprehensive Plan that are not in the ULDR. <br />Section 2-7.10, Fences and Walls. This section was edited to clarify that a six foot fence <br />or wall is not be erected in front of a residential structure. Diagrams have been added to the <br />ordinance to designate the front yard area that allows a three foot high fence. <br />The City Commission discussed amending the Code to allow for a four foot high fence in <br />the front yard. Staff conducted a review of codes from surrounding communities and <br />provided the information in the agenda packet for discussion. Staff also researched the <br />
