CASSELBERRY CITY COMMISSION <br />Minutes of November 10, 2008 - Regular Meeting <br />Page 16 of 32 <br />Appraiser with the Florida Department of Transportation, presented information to the City Commission <br />supporting adoption of the ordinance. As a follow up, Mr. Ellicott provided staff a memorandum requesting <br />that the various thresholds be removed from the ordinance. Based on the Mr. Ellicot's information, staff <br />recommended Ordinance 08-1250 be amended as follows: <br />(E) Waivers, exceptions and variances. <br />If, as a result of a governmental taking, either by negotiation or condemnation, existing lots, <br />parcels, structures, or uses of land become nonconforming with the provisions of the City code, the <br />following provisions shall apply: <br />(1) Existing characteristics of use which become nonconforming or increase in <br />nonconformity as a result of a taking, including but not limited to, minimum lot <br />size, setbacks, open space, off-street parking, landscape requirements, drainage and <br />retention shall be required to meet code requirements to the greatest extent possible, <br />to the satisfaction of the Administrative Official or designee. Thereafter, the <br />existing characteristics of use shall be deemed conforming only to the extent of <br />those nonconformities caused by the governmental or public agency's acquisition. <br />Waivers, exceptions or variances shall: <br />overall site. <br />Any further expansion or enlargement thereof shall be in accordance with all <br />applicable code requirements <br />Budget Impact: This item has no impact to the Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 08-1250 on second and final reading with the staff recommended amendments. <br />Public Hearing: The following individuals came forward and addressed Ordinance 08-1250: <br />1) Mr. John Casselberry, 700 South Lost Lake Lane, spoke in opposition to Ordinance 08- <br />1250. <br />2) Mr. Craig Tull, 420 Ranch Trail, spoke in favor of Ordinance 08-1250. <br />
